I believe that States can do what they want. That makes me a “tenther” I suppose.
Well then! They should be able to deny free speech! They should be able to shut down religion! Ban all guns! Quarter police in your home! Deny fair trials! Convict you without showing you evidence! Hold trial and not identify your accusers! Inflict cruel and unusual punishments on you! Deny you the right to remain silent!
Bless your heart.
That's southern-speak for 'what a moron'. LOL!
The Second Amendment doesn't mention Congress and doesn't mention States. It just says gun rights can't be infringed.
My opinion: no one can infringe without violating the Constitution.
The 10th Amendment, since you've never read it:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
It means the States must obey the US Constitution. It does not mean the US constitution only restrains the federal government and We the People have no rights if the States decide to take them. Saying that it does means you have no clue what the fight for the Constitution was all about, nor about the founding concepts of this nation. Your public school education failed you.
I am all for States’ Rights. States’ powers are all those not enumerated in the Constitution. The second is enumerated in the Constitution. How does that pave the way fo gay marriage again?
Then you need to pay attention to what the 10th actually reads:
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.
Notice the peohibition thingy?
Reread the 10th Amendment. It does not supersede any other Amendment of the Federal Constitution. The problem we have is Judicial Activism on the Supreme Court that chooses what parts of the Constitution it wants to ignore to pass an agenda. The 10th Amendment has been eviscerated by the SCOTUS with their Gay Marriage Ruling. Can't wait for the Incestuous Marriage Rights and Polygamist Marriage Rights advocates to get their day in Court now that the States have no power regulating Marriage. Once the Dam breaks, everyone drowns.
