Full title: Judicial Watch: FEC Must Investigate Democratic National Committee for Employing Illegal Alien to Craft 2016 Political Message
(Washington, DC) Judicial Watch announced today that it filed a complaint with the Federal Election Commission requesting that it investigate the Democratic National Committee (DNC) for having knowingly hired an illegal alien, Cindy Nava, to help craft the committees 2016 political message and communications. Judicial Watch filed its complaint on August 25, 2015.
A June 8, 2015, story in The Washington Post reported that the DNC hired Nava with full knowledge of what DNC chair Rep. Debbie Wasserman Schultz (D-FL) termed Navas undocumented status. The news report details that Despite not yet attaining legal status, Nava is working for the Democratic National Committee as one of a crop of fellows from around the country helping the party organize ahead of a presidential election that President Obama predicted would feature immigration as a major issue. The Spanish language newspaper El Nuevo Herald reports that Nava would help coordinate DNC outreach to women, youth, and Hispanics.
Federal law prohibits foreign nationals from participating directly or indirectly in the decision-making process of federal, state, or local election-related activities.
The Judicial Watch FEC complaint charges:
The United States has prohibited non-citizen participation in election related activities for over fifty years. The United States Supreme Court has held that such prohibitions are legally permissible under the U.S. Constitution In 2002, Congress expanded the prohibitions on foreign nationals to include anything of value that directly or indirectly contributes to a political campaign The Commission has stated foreign nationals [cannot] direct, control, or otherwise participate directly or indirectly in the decision-making process of [a] PAC.
On its face, the DNCs decision to hire Ms. Nava is in direct violation of this provision. The FEC should investigate this matter further to determine the full extent of Ms. Navas responsibilities, her relationship to the policy making team, and her effect on the 2016 DNC election strategy.
The United States Congress created a federal offense to knowingly hire an illegal alien. It is against Federal law to hire, or to recruit , for employment in the United States an alien knowing the alien is an unauthorized alien There are two elements to this crime: (1) knowledge of the aliens status, and (2) an employment offer
Thus, the DNC is violating federal law by hiring Cindy Nava. Her fellowship constitutes expenditures under the FEC regulation, and therefore these illegal expenditures are within the scope of FEC regulations They have actively employed Ms. Nava knowing that she lacked proper authorization to work in the United States.
Judicial Watchs request for a full, formal investigation concludes, These actions are particularly egregious because the DNC flagrantly promotes their illegal activities, lawlessness, and disrespect for the rule of law.
No wonder this nation has a border and an illegal alien crisis. Not only do we have a major political party knowingly employing an illegal alien, but also openly boasting about it to the nations press, said Judicial Watch President Tom Fitton. The DNC should be held accountable by the FEC for hiring an illegal alien in violation of both federal immigration and election laws. Frankly, the Justice Department and the Department of Homeland Security should also take appropriate law enforcement action.

Candidates are already staking out their positions. Democratic hopeful Hillary Clinton aligned herself with the president on his executive action and has come out supporting driver’s licenses for immigrants. Former Maryland governor Martin O’Malley’s vowed to work on the issue in his first 100 days in office, if elected, during a Q&A with the Hispanic Chamber of Commerce last week.
Sen. Bernie Sanders (D-Vt.) has also said he backs reform but was critical of guest worker amendments in a 2007 immigration reform bill that he said were “pushed by large corporations.”
Nava’s new position in the DNC’s political shop comes after Clinton tapped another former undocumented immigrant and activist, Lorella Praeli, to join her campaign team.

Growing up in Albuquerque and later Santa Fe, she said insecurity dominated her childhood. Her family moved from place to place early on looking for good jobs and stability. She struggled to navigate the complications of her status up until Nava enrolled in a dual-credit program at her local community college in 2008.
“I live in a country that I believe is my home but others don’t see it that way,” she said.
Nava became more involved in Democratic politics and open about being undocumented as she transferred to the University of New Mexico. After visiting the state legislature for the first time, Nava came under the wing of longtime Las Cruces Democratic state Sen. Cynthia Nava and other legislators. Nava, the Dreamer, bridged her advocacy work on immigration to her growing passion for lawmaking.
She became active in Democratic women’s groups and also campaigned for Obama in 2012, reaching out to New Mexico families of mixed immigration status. Nava said she tried to convince eligible voters in a family to advocate for their undocumented relatives.
Nava is still waiting to find out if her DACA application will confer the coveted legal status she has sought for so long. Meanwhile, she will be working with the party’s political operatives to craft policy platforms, research and broaden her political skills on social media at the national level.

UNM student selected for the National Federation of Democratic Women Award
University of New Mexico student and chair of the Young Democrats of New Mexico Women’s Caucus, Cindy Nava, will be awarded the National Federation of Democratic Women Founders Award in June in Kansas City, Mo., at the organization’s national convention later this month.
Nava will work with UNM Community Engagement Center and with the ENLACE program at UNM until the end of the year. Afterward, she plans to apply to a graduate program either in law or public policy. She is also an advocate for Legislative Lottery Scholarship and plans to continue working on the solvency of the scholarship while at UNM.
Recipients also must demonstrate heavy involvement within democratic women to support and encourage young women to be involved with the Democratic Party and to potentially consider running for office in the future.
