Judge orders Rowan clerk to appear in court Thursday after she again denies marriage licenses

A federal judge has ordered Rowan County Clerk Kim Davis and her deputies to appear in his courtroom Thursday and explain why Davis should not be held in contempt of court for refusing to issue marriage licenses.

Shortly after opening her doors Tuesday, Davis told two same-sex couples who asked for marriage licenses that she would not issue them, despite a federal court injunction ordering her to do so.

Davis, an Apostolic Christian, has refused to issue any marriage licenses in Rowan County since the U.S. Supreme Court legalized same-sex marriage June 26. U.S. District Judge David Bunning issued a preliminary injunction Aug. 12 ordering Davis to resume issuing licenses. She appealed to the 6th Circuit U.S. Court of Appeals and the Supreme Court, both of which denied her.

Davis, a Democrat, was elected to a four-year term last November. She cannot be removed from her roughly $80,000-a-year post unless the General Assembly impeaches her.

While he was inside Davis' office, Moore asked Rowan County Sheriff Matt Sparks to arrest the clerk for refusing to obey the law. The sheriff declined, telling Moore it was a matter for the federal courts, not for local law enforcement.

Never mind, I just read it, she’s elected. So wouldn’t the state’s recourse be to impeach her? The federal judge should go back where it came from.

She was elected to the 4 year term. She is a democrat. She earns $80,000. a year.

Couldn’t this be resolved by someone else at the courthouse issuing the licenses? A judge or another employee in the clerk’s office? That’s what’s happening in a local county here.

SCOTUS has decreed that gay marriage is the law of the land. IF we truly are a nation of laws, Kim Davis has two choices.
1: Issue gay marriage licenses
2: Resign her job.

In today’s American, only the black’s president is allowed to pick and choose the laws to obey.
Maybe someday, Our great grandkids will take it back, but for now the America of the founders is long gone. .

This judge is sitting where liberals love to be.. in a position to smite all who oppose their own personal views. Since socialism is not entrenched enough to have this clerk taken out and shot, yet, he will probably start with finding her in contempt.

The gay mafia is specifically asking for heavy fines (to ruin her) rather than incarceration (which would make her a martyr).

From what I have read, if she were impeached and removed from office but decided to run again (if allowed) she would win again.

SCOTUS decreed that Dred Scott was property and had t be returned to a slave status from a non slave state, so that’s the value of SCOTUS in many aspects. In that case, the SCOTUS WAS actually upholding the laws of the day, not creating legislation/rights out of thin air and political hack.

The people via elected legislators make the laws, not the judges or administration, they only serve to clarify and implement. These days they seem to neither very well.

Sorry, but federal courts have already told the states they do not have to enforce black letter laws regarding illegal immigrants - that they can blatantly ignore those laws. This clerk is simply applying the established precedence with respect to ignoring edicts and laws to which they object.

Why should we wimp out and dump the problem on "our great grandkids"? If they could change it, why don't we do it now?

We will be needing the Federal Government to promelgate a list of public employment positions great and small, in which practicing Christians are not allowed to serve.

I hope this woman is brave enough to go to jail.

As Obama has now set a precedent for selective enforcement, the next POTUS can choose not to act on such cases.
