Obama Plan for Immigration Action Gets a Cold Reception at Appeals Court

NEW ORLEANS — Government lawyers labored on Friday to persuade federal appeals court judges here to allow President Obama to move ahead with sweeping initiatives to protect immigrants in the country illegally. But the judges’ questions seemed to make it ever more unlikely that the president’s programs, which he has hoped would be a central piece of his legacy, would start any time before the last months of his term, if at all.

A panel of three judges of the United States Court of Appeals for the Fifth Circuit heard arguments in a lawsuit by Texas and 25 other states challenging executive actions Mr. Obama announced in November that would give temporary reprieves from deportation to as many as four million immigrants and also permit them to work.

In February, a federal district judge in Texas blocked the programs. On May 26, a panel of the Fifth Circuit denied the administration’s emergency request to cancel that injunction, with two judges supporting the denial and one dissenting. This time, the judges heard a broader appeal by the government on the challenge to the executive actions.

But even though the judges issued no decision on Friday, it seemed highly probable that the administration would lose. By a stroke of bad luck for Mr. Obama and good fortune for the states bringing the lawsuit, two judges on Friday’s panel — Judge Jerry E. Smith and Judge Jennifer Elrod — are the same conservatives who ruled against the administration in May. Court officials said both panels had been randomly selected, well before the administration even brought its case to the Fifth Circuit.

I've noticed the lib media lately has begun harping on the "Obama legacy." They're almost hysterically trying to find something other than "complete failure." Remember, this is the "First Black President" that the lib media created out of whole cloth. It cannot be allowed to fail!

they (media)like he will point to Obamacare as a success. Now even though they will stake out that position they know its at best a dubious claim. Foreign policy is a disaster which accounts for his unending extensions to Iran. I usually watch BBC over the week at this time and either Thurs or Fri they were grilling one of Obama’s flacks calling his middle east policy something along the lines of absolute failure. He also watched Russia gobble up a chunk of the Ukraine. One might hope at worst a president simply had no foreign policy blunders. To have a disaster on record is a nightmare to the left.
By this point only an idiot would point to the headline jobs number and ignore the underlying weakness of the participation rate.
Race relations are about as bad as they’ve been since i was a kid in the 60’s.
He’s pushing through a secretive trade policy that the left abhors.
The left likes to say he pulled us through the 2008 crash but we still suffer as i pointed out above in the labor market and what growth we’ve had has been anemic at best anyway.
Legacy is simply a record of what one’s done. He has 17 or 18 months to go with precious little to point to as of now. The Times understands this. We will probably see plenty of revisionist history going forward. Its about all they can do at this point.

Honestly.. Do you think some or most of them are working anyway? Sometimes I think it would really tick off the democrats who use immigrants as semi slave labor. Sometimes I think I am wrong about that. If they pay all taxes and their employer pays all the taxes that are required for citizens, would that help us or hurt us? I just don’t have a good answer to the immigration thing, except secure the border now.

I agree with that. The court has no enforcement arm other than the justice department, and it’s run by the guy they’re ruling against. That is probably a difficult result of the separation of powers, and maybe it could be stroked a bit, but I’d be hesitant to give police powers to unelected oligarchs. They’d have the Oregon bakers in jail by now if they had the police at their beck and call.

If I had the authority to do so, every single illegal immigrant would be deported. I would give them 60 days to leave voluntarily. If they didn’t then forced deportation would be used.

Only Judge Hanen and the 2 others on the appeals court stand between the citizens losing their country and both parties giving it to fraudulently documented foriegners.

Why didn’t the House sue the day after Obama implemented the DREAM Act that never passed Congress?

They want amnesty, too.

If there is one thing this marxist son of a whore has demonstrated it’s that there is save impeachment effectively no check on the Executive Branch, and it’s power is limitless.

He could have his own secret police running around arresting and imprisoning his opponents if he wanted too, but the lazy queer just uses the DOJ, threats, and blackmail instead.

Permit them to work. Great. Then they should also be exempt from tax exempt status, no matter what their gross income is. They want to be here and take jobs away from UNEMPLOYED CITIZENS then they can damn well contribute to the support of this country and the citizens. Otherwise, deport. And, regardless of the law that, if passed, permits them to work, their EMPLOYER still needs to pay a HUGE fine for hiring ILLEGALS instead of CITIZENS.
