Law Enforcement Response to Waco Shooting Raises Constitutional Questions

Serious constitutional and civil rights questions have been raised regarding the blanket fill-in-the-blank arrests of 170 bikers in the wake of the Waco Twin Peaks shooting and the subsequent excessive bail that was set. Breitbart Texas investigative reporter Lee Stranahan and KTSA radio talkshow host Trey Ware recently discussed some of these issues on Ware’s morning show.

Ware, a self-admitted motorcycle enthusiast, opened the segment saying, “I have probably a greater interest in this story than most. But, it extends beyond motorcycles. My interest in this goes into civil rights. Now, I have no clue how many of those men and women who were arrested and held on a million dollar bond were actually involved in any kind of crime.”

“But, the point is, neither do the officials,” Ware continued. “And the way we don’t do things in America is cast this net and ‘haul them in and then we’ll just sort it out later’ after they’ve lost their jobs and everything else.”

Ware explained the proper procedure of identifying the individuals where reasonable suspicion suggests criminal activity. We then investigate what, if any, crimes they may have committed, and then obtaining an arrest warrant for those actually involved in crimes. “This has worked completely the opposite way, in this case,” he concluded. “That should be of concern to everyone, not just bikers.”

For reference. This is the statute under which 174 were rounded up, arrested off of carbon copy, fill in the name affidavits, and held under $1,000,000 bonds.

These RICO laws seem to be infinitely malleable in order to “get” whoever needs “getting.”

My questions include: What actionable intelligence led to the police ambush setup? Who led the briefing? Who designed the rules of engagement? Who approved the RoE? Who was in charge at the restaurant? What was the goal? etc.

Constitutional protections don’t work too well in a war zone. Perhaps the best police response would have been to let them kill each other off and arrest the last couple standing.

In my opinion, that remains very much an open possibility. The authorities are sitting on things so tight that the whole thing continues to NOT pass the smell test. And the smell from Waco is getting more rank by the day.

What discussions/planning sessions were held between the Obama regime’s DOJ/BATF/FBI operatives who were working with compliant local Waco police prior to the “incident” and what is the subject of their ongoing current discussions? Are they trying to figure out how the hell they can continue to keep a lid on this?

I haven’t read it, I trust your judgment and will take your word, but from the way you described it, It is similar to the “King’s Warrants” carried be the English representatives of the Crown in colonies. If so, it was/is specifically forbidden by the Fourth Amendment of the Constitution. In fact, they were the reason the Forth Amendment was put in. However, since by popular demand of the voters in 2008 and 2012, we only operate under the guidelines of the Constitution when it suits the purpose[s] of the Left, a/k/a Socialists, it does not matter. Does it?

I thought Waco was a part of Texas, but I’m not so sure anymore. What happened to the Texas system of justice we used to know?

Waco officials appear to be acting like they’re under the old Mexican system of justice where you’re rotting in jail waiting until a local go-between lawyer can negotiate a deal with all the “right” people.

I hope the taxpayers and voters of McClennan county are paying attention. They’ve got some issues that need their attention in the next election cycle.

PS. If this were really old Mexico, those who did not make a deal would be killed in the next jailbreak attempt or commit suicide. This is why Texas mothers teach their children to stay out of Mexican jails at all costs.

Waco police and media have a history of this kind of corruption. Back in the 80’s, DA Vic Feazell embarassed Waco police and Texas Rangers over Henry Lee Lucas’ obviously false confessions, so they had Feazell falsely indicted.

Fezell was found innocent and won an 80 million dollar libel suit against WFAA in Dallas.

Sounds like the stripes haven’t changed.

My comment:
When are you so-called reporters going to demand to know a few basic facts in this case, facts that are certainly known to the Waco PD and ATF, such as:
HOW MANY ROUNDS WERE FIRED AT THE TWIN PEAKS BY LAW ENFORCEMENT?

Trust me, they know that exact number. Why won’t you “reporters” (sic) in Waco’s paper of record demand to know that number, and report it? At this point, it looks like you have sold your souls to the devil, and are part of the cover up of the Waco Police Massacre.

It’s as if LT Calley made his official report: “Company C just happened to be hiking past the village of My Lai, and there was some kind of a feud breaking out between rival Vietnamese clans. So we stopped it.”

And the Waco Trib just nods and says, “Sounds reasonable to me, LT Calley.”

HEY “REPORTERS,” HOW ABOUT DEMANDING TO KNOW HOW MANY ROUNDS WERE FIRED BY THE WACO PD, SWAT AND ATF???

Don’t you “reporters” have ANY self respect? You might as well be working for Pravda.

Not to mention that “no excessive bail” is right in the Constitution! 170+ arrested on identical “fill in your name” warrants–on million dollar bails–is not an effort to find the truth, but to bury it.

When will a single Waco Trib reporter actually start asking the real questions?

Sorry, I forgot, you just work for “American Pravda.”

Thank you, LT Calley, for your description of the events at My Lai. Now we understand, Company C just happened to come along just in the nick of time, to stop a bitter fight between feuding clans of Vietnamese. Now it all makes sense.
