Laurence Tribe, a liberal constitutional scholar at Harvard University, told House lawmakers that EPA carbon dioxide regulations are tearing the Constitution apart.
EPA possesses only the authority granted to it by Congress, Tribe told lawmakers in a hearing Tuesday. Its gambit here raises serious questions under the separation of powers because EPA is attempting to exercise lawmaking power that belongs to Congress and judicial power that belongs to the federal courts.
Burning the Constitution should not become part of our national energy policy, Tribe added.
Tribe, along with other legal and energy experts, appeared before Congress Tuesday to give testimony on the EPAs Clean Power Plan the agencys plan to cut carbon dioxide emissions from new and existing power plants. Tribe told lawmakers the CPP is unconstitutional and outside the agencys authority.
EPA is attempting an unconstitutional trifecta: usurping the prerogatives of the States, Congress and the Federal Courts all at once, Tribe told lawmakers.
This is not the first time Tribe criticized the EPAs power plant rules.

The EPA is only trying to get more monopoly money for some water heater, wood heater and natural gas interests (gas-fired power plants).
So, this being the case— Congress leadership should shut down and defund the operations and actions of EPA that violate the Constitution— on the basis of Constitutional powers of Congress superseding any agency “regulation”.
And, businesses should ignore EPA, having the backing of the American People.
I don’t understand why Congress doesn’t reign in these rogue agencies.

Now, now. That's not true.
They are only taxing the air you breathe OUT - The air you breathe in is still tax-free.
In CA, the water you drink is taxed though! Except for that run out of the dams to let an imported fish continue to breed.
The simplest explanation is that it is because the Congress agrees with these agencies and their regulations.
A great example is when the NSA was revealed to be engaging in domestic espionage on us, the citizens, the congress basically wrung their hands saying how awful
or justifying it (because we gotta catch those terrorists
) but not actually doing anything about it. (The IRS, EPA, BATFE, DOJ, etc are all the same.) — In short, it allows them to avoid accountability by whining and crying that it's the executive branch.
Temps were 30 to 50 degrees Fahrenheit above average for the winter here (high spot on the Rockies), but I was in a weird weather spot, probably for this last winter only. Temps usually go into the minus-30s and may well do that or worse next winter. Wind gusts go over 100 sometimes in this little spot. Seeing some unusual fluctuations and not as many windy periods this year (so far).
It’s not man-caused global warming, of course. What we’re seeing is uncommon for us but perfectly natural. You probably already know about the general decrease in sun activity as part of the extended solar minimum. Nothing we can do to change that.
Magnetic north is also on the move because of outer core and mantle activity—only happens once in a great while. As that happens, the field weakens in spots. Unusual weather patterns form for a time.
There’s nothing we can do to change it. We accept it, adapt and move on. Meanwhile, political groups grasp at anything to disseminate their maniacal messages and try to grab more socialist funding from other political groups.
Tribe’s a big time lib, but at least here he’s an honest one.

According to the EPA website, the agencys very first budget in Fiscal Year (FY) 1970 was just over $1 billion. In the ensuing years, the agencys budget grew steadily until it exceeded $10 billion in FY 2010. That amounts to an average annual increase of about $225 million over 40 years. That growth in the EPA budget includes a very large increase from FY 2009 to FY 2010 of $2.65 billion, a one year increase of more than 10 times the annual average increase over 40 years, and about 35% over the FY 2009 budget.

The agency gets $8.1 billion, down $60 million from the last fiscal year. The agencys budget has been slashed by $2.2 billion, or 21 percent, since fiscal 2010, according to GOP aides. The cuts mean that EPA will have to reduce its staffing to the lowest levels since 1989.
More cuts. Reduce staff and budget until eliminated.
