Part II: Iran Responds to GOP Letter

Asked about the open letter of 47 US Senators to Iranian leaders, the Iranian Foreign Minister, Dr. Javad Zarif, responded that “in our view, this letter has no legal value and is mostly a propaganda ploy. It is very interesting that while negotiations are still in progress and while no agreement has been reached, some political pressure groups are so afraid even of the prospect of an agreement that they resort to unconventional methods, unprecedented in diplomatic history.

Foreign Minister Zarif added that “I should bring one important point to the attention of the authors and that is, the world is not the United States, and the conduct of inter-state relations is governed by international law, and not by US domestic law. The authors may not fully understand that in international law, governments represent the entirety of their respective states, are responsible for the conduct of foreign affairs, are required to fulfil the obligations they undertake with other states and may not invoke their internal law as justification for failure to perform their international obligations.” [snip]

In addition to his self-serving posturing, Zarif is attempting to put the US Senate letter-signers on notice that the US Constitution will not govern this pending deal, but what he calls "international law." Inasmuch as the US is a endorser of such international law it would have come through the Senate Treaty ratification process. Obama has changed the rules, flaunting a myriad of US safeguards in the process.

Here we begin to see the potential for extreme damage a rogue foreign policy dictator can do to the US and the world. The international community and its laws have heretofore been conditioned by US presidents that actually represent their constituencies, the Kyoto Protocol notwithstanding. By Obama's unprecedented announcement and outing of the fact that he had no intention of seeking Senate Ratification, or even Congressional review, this Constitutional crisis truly threatens world stability.

Iran has signaled its intent to proceed irrespective of any Senate Ratification question (calling that suggestion by the Senators "propaganda") and suggests the international law will support its position. So that's a big thumb right back at the Republican senators' eyes. Iran will keep Barry's 10-figure sign-on bonus, be ready--as the world's least-constrained Nuclear Non-Proliferation Treaty "adherent"--to deliver its arsenal through the air onto Jerusalem and Washington ten year's from now by having cheated all along the way, as it has done throughout their post-Shah theocracy.

Except, it simply isn’t unprecedented. This is pure projection by radicals both in Iran and in our own white house to detract from the reality that Iran has nefarious intentions and that regardless of any “agreement” that is reached, Iran will flout international law to meet their aims. They have a proven track record in that regard, so anyone who believes Iran’s intentions are pure is deluded, plain and simply deluded!

This is just more confirmation of an already confirmed animus toward what the US really stands for - by both the Obama admin and those that aid and abet the lawlessness.

Iran should read the US Constitution. There is no treaty unless and until a proposal is approved by a 2/3 vote in the Senate of the United States.
This is part of the checks-and-balances our Founders built into our Constitution, to protect us from a president someday making a bad or sell-out treaty that endangers America.
(WOW! Those folks were sure prescient, weren’t they!?)

It obviously serves Iran's interest not to give heed to the US Constitution, since our government continues to allow the repository of most of its foreign policy, President Obama, to make all manner of representation that he doesn't intend to let Congress have its required Constitutional review or ratification.

From Zavid's letter, I'm confident they'll let Barry's signature and multi-billion dollar sign-on bonus stand as the official US position on the matter, irrespective that they will continue their cheating ways regarding matters pertaining thereto.

I believe impeachment articles must be presented and passed immediately; let the chips fall where they may, even if that seems to do little more than identify Democrat Senators that self-proclaim as traitors to the Constitution.

Gee...I guess making it up as you go along, telling lies and having NO understanding of actual historical fact are leadership flaws NOT restricted to OUR President!! :)

Well ... it is clear that this guy in Iran doesn’t understand the USA and how it works ... LOL ...

WHAT he doesn’t understand is that the President cannot bind the nation to a treaty with another nation without it being approved by the Senate. Now, the President can take unofficial actions and do things during his term in office that are not a treaty with another nation, but that other nation should not think that these actions are in any way binding on the next President or that Congress cannot act and outlaw certain actions.

And then the article says ... Foreign Minister Zarif added that “I should bring one important point to the attention of the authors and that is, the world is not the United States, and the conduct of inter-state relations is governed by international law, and not by US domestic law.

THE PROBLEM here is that there is nothing in International Law that can make the USA do something that was never approved by the nation in the first place. SO ... even if the President were engaging in unofficial actions, as stated above, the next President is not bound by those unofficial actions and the nation is not bound by those unofficial actions, no matter what this foreign minister thinks.

And then ... “The authors may not fully understand that in international law, governments represent the entirety of their respective states, are responsible for the conduct of foreign affairs, are required to fulfil the obligations they undertake with other states and may not invoke their internal law as justification for failure to perform their international obligations.”

VERY BRIEFLY, it is NOT an “international obligation” since it would not have been an obligation that was entered into by “the nation” in the legal manner required to do so in that nation.

And lastly ... The Iranian Foreign Minister added that “Change of administration does not in any way relieve the next administration from international obligations undertaken by its predecessor in a possible agreement about Iran`s peaceful nuclear program.” He continued “I wish to enlighten the authors that if the next administration revokes any agreement with the stroke of a pen, as they boast, it will have simply committed a blatant violation of international law.

ONCE AGAIN ... there is NO LEGAL OBLIGATION if it is not formally enacted in the manner required by law in that nation. Iran cannot enforce something as an “international obligation” just because it wants it to be. It has to be FORMALLY and LEGALLY ENACTED within that nation.

Iran’s Foreign Minister is “blowing smoke” and talking AS IF he actually knows what is CONSTITUTIONAL in the USA ... LOL ...

What I'm confident they're looking at is ten years from now, whenever the agreement is vacated by a non-socialist President, or whenever Iran's secret or Agreement-allowed munitions are set to explode in Tel Aviv, Jerusalem and the Washington, they will attempt to finish off their "Great Satan" and "Little Satan."

They must be stopped.

Agreed, yet I point you to what I posted in #12.

Iran's government is crazy enough to do what it has threatened. Barry is enabling them, literally inviting the damage they will do, while simultaneously acting treasonously domestically.

His treason is so far beyond doubt that it has become Boehner's treason not to allow him to be impeached.

The thing to ALSO realize here is that we could stop every last single thing that Obama is doing with Iran and prevent him from even agreeing to a single thing with Iran ... AND ... Iran would still do what it’s doing with impunity.

If Obama sat back and did nothing (with an agreement) Iran would still do what it’s doing. If Obama was MORE conservative than the conservatives on making a deal ... Iran would STILL do what it is doing.

IN OTHER WORDS ... no agreement or even the lack of an agreement will get Iran to do other than what it intends to do anyway!

That's why crippling sanctions seemed to be our best shot against their doing whatever they want to do with impunity. Obama is in essence, working against sanctions and getting nothing more (actually much less) than a totally-uncertain 10-year bomb reprieve, after which time it will be expected to have nuclear weapons. Wow, ten more years to let older, better educated Americans and more hard-line Israelis die off!

IOW, the agreement does little more than give Iran what it wants in place of sanctions. 1) rid economically crippling sanctions, 2) give them money, 3) rid them of yapping nations demanding accountability through IAEA, 4) Be able to blow us and the Israelis up in ten years.

Even though many in the US aren't fooled by an unratified treaty, Obama as president is charged with executing most of US foreign policy, so will be able to hold the terms in place during his term. How he hands out billions in apparent slush fund money not authorized by Congress is beyond me, but the House obviously chooses not to rein in such spending.

The Obama administration has thrown up its hands saying there's little they could do to keep Iran from getting nuclear weapons, despite Tehran's assurances that their nuclear ambitions are entirely peaceful and for domestic power production.

The US and others could have stopped all centrifuges, taken all Iran's weapons grade materials, and ICBM tubes, gyros and engines and sold Iran at market prices all the power-plant-grade materials it needed. What they actually use in such venues, we would agree to replace. Boom! Their claims would be laid bare as if they weren't already. They're done. No nuclear weapons production agreed-to.
