Domino’s to Obama Admin: Calorie Rule is ‘Unworkable’

The final Obamacare regulation forcing restaurant chains to display calorie information is causing headaches for companies who say it is “impossible to comply” with the new rule.

Domino’s Pizza, one of the regulation’s most outspoken critics, said the rule from the Food and Drug Administration (FDA) is vaguely written and carries the possibility of jail time.

“Essentially we think this rule is a kind of disaster for everybody,” Lynn Liddle, executive vice president of Domino’s, told the Washington Free Beacon. “Not just pizza but restaurants, and anybody that’s going to fall within this law. It’s still not workable.”

One problem, Liddle said, is that the final rule broadly expanded the definition of what qualifies as a “menu.” Under the rule “menu” can refer to any writing that “used by a customer to make an order selection at the time the customer is viewing the writing,” which could apply to advertisements.

“We no longer know what a menu is,” Liddle said. “It’s really hard to interpret. Essentially they’re saying anything that a consumer can look at and make a potential ordering decision from is a menu.” She said this could apply to flyers, ads in the newspapers, or signs in the window.

“If you take it to the broadest thing it could be an ad on the television,” she said. “That makes it literally impossible to comply.”

A problem specific to pizza chains is the challenge of displaying a vast number of possible calorie totals across all of the materials that the rule potentially counts as a “menu.” Considering that Domino’s customers can customize their own pizzas, there is an endless number of possible combinations of toppings, each of which has a different calorie count. Liddle said a low-ball estimate of combinations Domino’s offers is 34 million. Pizza Hut has 2 billion possible combinations.

Don’t think for one second it wasn’t designed to be legally vague and confusing.

They want it to be a vehicle for massive torts by shyster lawyers looking to redistribute wealth to obama’s homies and others. They want this to cripple the economy.

They hate people eating pizza and all the money that people still spend on food they like to eat. Proles cannot be allowed to enjoy food like the obamas and their children do.

Not just the demand to post calories, but all 11,000 pages of that worthless and damaging garbage is “unworkable”.

If a person is buying a pizza, that person is not counting calories, fats, or carbohydrates, eh?

Seems that a point of sale kiosk could be available

a. choose the size of the pizza
b. choose the toppings
ham
ground beef
bacon
cheese
sauce
garlic crust

present the calories/fats/carbohydrates per slice, per pizza

provide a web link to a page that will generate the information.

but, agreed, it isn't going to be in an ad, in menu ad (I've received those in hotels), on a radio or TV ad.

Does Burger King have to include segregated and itemized caloric information for each and every sandwich they sell, itemized by ingredient/topping information? How many different combinations are possible with a hamburger (or pizza)? Throw a couple of different types of crust, sauces, and a dozen or more toppings and the number grows exponentially.

And in reality - if someone is too stupid to have a clue as to the nutritional value (or lack thereof) of their slice of pizza or burger - then how is some government regulation going to help that? This is just another case of radical nanny-state regulations.

Its the same mentality that has an ever-growing list of labeling requirements on nearly any substance or product sold - so much so that packaging has to grow just to have room to fit it all, even with tiny,practically- illegible printing...

What part of “this product is a poison” requires pages of text on a can of bug spray?

Why do hair dryers have to have massive tags warning consumers to not use them in the shower or bath?

Sigh...

Difficult and expensive is no big deal to the feds, just do it.

Heck, they told the gasoline suppliers that had to include more cellulose ethane than existed available in the global market, then fined them for not including it.

Pity the poor needy person or otherwise disenfranchised type, who does not have any access to get the info through a web link. It only makes sense that everyone be given a free tablet and/or smart phone, so that they can check their pizza calories before ordering.

You are right, except that instead of a web link, the calorie info comes up on a screen, and the customer must acknowledge that they have read and understand that information in order to complete the transaction.
