A Ten-Step Program for Constitutional Recovery

By now, you’ve likely read plenty about how the Constitution has been twisted to give the federal government power far beyond anything the Founders ever planned. You already know the dangers of an unchecked President, of a Congress that passes bills without reading them, of agencies that do what they want, and judges who believe in precedent over original meaning.

So I won’t waste your time sharing more of the same.

Is the situation hopeless?

Absolutely not.

But in order to actually turn things around, a few sacred cows need to be dealt with. Here are TEN STEPS you should take right now to set the stage for a dramatic Constitutional recovery.

Recognize that massive change will only come through a revolution in thought. John Adams forcefully asserted that the American Revolution was not, in fact, the war for independence. The “real American Revolution,” Adams wrote, was a “radical change in the principles, opinions, sentiments, and affections of the people.”

Take an honest and fearless inventory of the current situation. It’s not just Obamacare that violates the Constitution. It’s almost everything these people do, from telling you what size toilet you can have, to what kind of light bulb you can buy or what kind of plant you can grow and consume in your own backyard. It’s their federal reserve, their wars, their executive orders, their regulations, their “national security,” and everything in between. Entire agencies – ATF, DEA, TSA, and many others – shouldn’t even exist, much less do what they do. Even programs you like, or feel entitled to because they’ve forced you to pay for them for years, are constitutional violations.

Where’s our 45 Step Plan to counter-act all the things found out in the early 60’s? I.E. the Commies Game Plan to destroy America, that was a 45 Step Plan if my memory is correct...

I've got three steps out of the ten:

1) "The Incorporation Doctrine" (judicially misapplied to the 14th Amendment). Originally intended and limited to forbidding state laws segregating former slaves as confirmed in the 1872 Slaughter-House Cases, the 14A has been construed by SCOTUS, ignoring original intent and precedent, to allow the feds to enforce the first Ten Amendments and interfere with state laws leading to a parade of horribles like banning prayer and Bible study in state schools, 70+ million abortions, threatening gun rights, interference with state marriage laws, threatening free exercise of religion, etc.

Solution: As per Slaughter-House Cases, an amendment clearly limiting the 14A to prohibiting state segregation laws and prohibiting the federal government from enforcing the first ten amendments upon the states. The federal government may only enforce the first ten amendments upon itself.

2) The [Interstate] Commerce Clause (Art I, Sec 8, Cl 3). Originally intended and limited to deal with commerce issues directly between the states as confirmed in Schechter Poultry Corp. v. United States in 1935, the CC Clause has astonishingly been expanded by SCOTUS, ignoring original intent and precedent, to give the feds almost unlimited power over intrastate and local economic activities leading to minimum wage laws, individual subsidies, and interference in just about every business enterprise and economic endeavor, the latest, most obvious being the push to socialize healthcare with "Obamacare".

Solution: As per Schechter Poultry Corp. v. United States, an amendment clearly prohibiting the federal government from interfering with intrastate transactions that have only indirect effects in the sphere of interstate commerce.

3) The "Necessary and Proper Clause" (Art I, Sec 8, Cl 18). Originally intended to allow executive enforcement and regulation pursuant to legislation within the scope of the Constitution, the N&P Clause has been expanded beyond constitutional grounds and limits to such an extent that a quasi-fourth branch of government has been created: the Administrative State with behemoth bureaucracies like the $1 trillion unconstitutional Dept of Health and Human Services.

Solution: An amendment that directly calls for abolishing all unconstitutional administrative activity and bureaucracies. This would include a time-phased teardown (not more than 2-3 years total) of the Dept of Health and Human Services (HHS - $1 trillion budget), the FDA, the FCC, Dept of Agriculture, Dept of Labor, HUD, Dept of transportation, Dept of Energy, Dept of Education, EPA, the Small business Administration.

This could mean the loss of jobs to hundreds of thousands of federal employees including officials, bureaucratic mangers, and department heads. This could also mean the loss of income to hundreds of thousands of people dependent on federal government. Hardly politically popular. Of course, there would be phase-out, phase-in periods, hopefully allowing time for the states and free market to replace these jobs and dependencies. There would be howling, wailing and gnashing of teeth. Hard to imagine it would happen.

Yet, if we are serious about putting the feds back into their constitutional cage, that is about what it will take. If the output of the proposed convention is ratified amendments that come even close to mandating this, one has to ask, what mechanisms are in place to enforce such radical change and results? The real issue could be enforcement of the results of amendments that significantly cut the size of government.

The relevant point. All else is commentary.

Which is why I so greatly miss Breitbart. He was the only leading conservative who seemed to fully comprehend the critical importance of entertainment and popular culture.

Politics is downstream of culture. The mess we are seeing now is the result of conservatives abandoning the cultural battlefield to progressives for at least 5 decades now.

If you don't fight, you can't win. And we haven't fought on that field.

Parents must start making sure that their children are taught about the federal government’s constitutionally limited powers, particularly Congress’s Article I, Section 8-limited powers.

Step 1 - Repeal the 17th Amendment and the rest of that list will fall into place with no problems at all.

State Legislatures, solidly Republican.
National elections like the Senate, a struggle.
Buy a clue, people.

Progressives pumped the 17th Amendment for a reason and it wasn't to make the Senate more responsive to the voters in their home States. It was because those yokels out in the sticks had too much say over who served in the Senate and their urban power base wanted them taken out of the equation.

Exactly ..!! Just look at CA. The state govt is totally out of control. It’s so liberal .. you can’t get a single level-headed conservative idea into the state’s agenda.

Now, they’re still trying to get a new rail line .. when over 4 million people have left the state because of NO WORK.

Your proposals would require firing millions of federal employees. These are people who are not productive, and would be forced to change their lifestyles. There would be an end to the welfare state. Your proposals would also facilitate the re-creation of manufacturing jobs in our country and completely disable the stranglehold of unions while allowing for job growth. And worst of all, your proposals will allow the individual states to kick out illegal immigrants.

You propose the total destruction of what the progressives have been working on for over a century.

Yes, I agree that that is the $ quote. I also think that many here would agree however, that “change in thinking” that is needed will only come about when there is a change of heart. America is going down unless we repent and return to our Creator. He, and He alone has the power to give us a new heart with new desires. He is able - are we ready and willing to let Him have His way in our hearts, lives, and nation?

Seems nothing was done then, as now, except for posting the Commies Game Plan. A graduate with a community organizing degree being elected head of the executive branch is proof that killing a slow growing fungus within the walls or termites in the foundation needs radical treatment, not spot cleaning. I learned in the 60’s (and it is still taught today) that McCarthy was a nut.
