To effectuate this repeal, Congress simply directed that "the provisions of executive order 12806 shall not have any legal effect."

Should be 'Game-Set- Match' by Congress.

But it would not surprise me in the least if the bureaucracy, loaded as it is with statist toads, goes into action on the word of the president in spite of what congress says.

I wonder what then.

Was wondering when someone would point this out.

Perhaps Boner thinks the no funding option is less offensive to Mexico.

Or perhaps if the electorate finally figures out that Congress COULD repeal such abominations as EO 11246 then they would be held accountable.

Can’t have that.

Great research. It is very intuitive; if the president oversteps his constitutional authority, then Congress can bat it down. Otherwise, without hyperbole, we have a dictatorship, and a confederacy of fools in Congress to let it stand. If I remember correctly, the Constitution gives Congress the authority to set aside Supreme Court rulings.

He doesn’t want to humiliate him. Obama must know this is what’s coming down the pike. This is why he wasn’t interested in being President if he lost the Senate.

Nothing he could do. All the crap in the press - bluster. Doesn’t mean anything.

What does “simply directed” mean in terms of the Constitution? Did both Houses of Congress pass a bill declaring that a referenced E.O. does have any effect, knowing that the president would either not sign the bill, or possibly veto the bill. And if vetoed, Congress then using its constitutional Clause 2 of Section 7 of Article I power to override a veto with 2/3 vote of each House of Congress.

The House approved a bill to rescind the executive order President Obama signed last week that ended the pay freeze on federal employees, which meant that some federal workers would be getting a raise—including members of Congress. A number of lawmakers spoke out about the absurdity of the pay increase and timing of the move. Rep. Michele Bachmann said in a statement, “This executive order was not requested by Congress and we should reject it. We have a spending problem in our country and we should be looking for areas to cut spending. At a time when families across the country are cutting back we should not increase government spending and add to the debt burden by giving members of Congress a pay raise.”

I’ll have to correct my own post. There is some clause in the Constitution that gives Congress the authority to limit the Supreme Court in its rulings, not necessarily the authority to reverse a ruling.

I’m skeptical that BO will do this. We all know that he is a coward. Right now, he’s just acting like a teenager who’s Dad told him he couldn’t do something. He’s being defiant and immature and stomping his foot to get his way for a bunch of people here illegally that have no say (as of yet)in anything. Someone on Cavuto said there are dems nervous about BO doing this too. Boehner did say “nothing” was off the table. Hmmmmm....
