Question: Did Congress adjourn before the elections? If so, don't both houses have to agree on being in session? I recall that the House didn't adjourn precisely to prevent Obama from doing recess appointments, because the House has to agree to any recess. If so, presumably the House has to agree to go back in session too.
Wondering whether the House should refuse to go back in session, to prevent the Senate from acting. Recess appointments only last until the next session, which is next January, so that is not a fear any more.
