The Supreme Court followed up the landslide election on Tuesday with its own shocker: it announced that it will hear the Burwell case, which challenges the Obama administrations extension of insurance subsidies in states that do not have health-care exchanges.
I think the chances are high that the administration will lose. Because:

Oh, honestly.
Roberts will save tehm. (Thank you, President Bush.)
Four reasons from the article:
1. The plain text of the statute denies subsidies to people who live in states without an exchange.
2. There was no split in the circuits; the lower courts actually seemed to accept the Obama administrations misreading of its own law.
3. I assume Chief Justice Roberts is with the original four dissenters from Sebelius two years ago in opposing the administration.
4. The Court will be acting in agreement with, rather than against, majority wishes.
Four reasons they will probably vote for it: Bribery, blackmail. stupidity, evil intent.
this bill was written in a tortured way to make sure CBO did not score the mandate as taxes.

I disagree. It will be upheld as Roberts broadly hinted that Congress has the power of redress in the future. Robert’s will look like a bigger patootie if he now switches sides and no Justice has a diminished sense of ego let alone the Chief Justice.
Then the revolution really starts.

There is one reason. The GOP took power. Thats it. Had the dems won again, the USSC would have codified it.
Elections have consequences.

Don’t ever theorize what the SCOTUS will do. All one has to do is look at Roberts and Obamacare.
Next up will be how to handle [politically] all the people who have to suddenly go without subsidies.
#3 assumes that John Roberts won’t perform legal gymnastics to give Obama what he wants.
The article is not completely accurate. The law provides IRS subsidies to those enrolled in exchanges ESTABLISHED by the state. About 15 states established their own exchanges. The rest didn’t and by the wording of the law, residents of States without their own are not eligible for tax credits, but the IRS is giving them to them anyway.
Obama ignores the words “established by the states,” and that’s what this lawsuit is about. He, of course, claims the all knowing and all powerful Federal Government is
“The state.” Although you won’t find the Feds referred to as “the state” anywhere in the Constitution or other law.
Roberts is being BLACKMAILED.
