Here to Stay: Why the New Republican Congress Can't Gut Obamacare BY MAGGIE FOX

Republicans may have promised to repeal or at least do a big makeover of Obamacare now that they control both the House and the Senate, but most experts believe it’s lip service only.

The 2010 Affordable Care Act is in full force across the country, with internet-based health insurance exchanges up and running, expanded Medicaid in 28 states and strict new requirements for health insurers. Here are five reasons the GOP-led Congress won’t be able to change much.

The veto.

This is the big one: President Barack Obama still has veto power. Republicans may have a majority in the Senate, but they don’t have the 60 seats needed to override a Democratic-led filibuster or a presidential veto. And Obama’s not going to allow his signature piece of legislation to be gutted.

They like it.

Republicans actually like a lot about Obamacare. It’s great business for health insurance companies, which in turn give plenty of money to Republicans. Republicans have also always agreed that more Americans need to be covered by health insurance. They just haven’t always agreed on how to get there.

“The five major national health insurers have all seen their stock price at least double — one has almost tripled — since the ACA was enacted, and they’ve all been raising their earnings estimates,” says Jay Angoff, who helped construct health reform at the Health and Human Services department before returning to private law firm Mehri & Skalet. "Republicans are not going to try to repeal a law that has been such a boon to insurers: They are still a Republican constituency group."

I have to predict the court is about to eliminate it. Kennedy, Alito, Scalia and Thomas will all vote the same way they did before. Roberts will find it much harder to deny the Republican case this time. Its in the law, black and white. The states shall grant subsidies, not the feds.

Once that goes, the law is bankrupt.

And once the law is bankrupt, the outrage will begin as the subsidies disappear. Enough Democrats will join Republicans to override Obama’s veto.

It will probably implode on it’s own. That’s what it was designed to do so single payer could be implemented by a socialist congress.

They delayed the new rates until after the election. As we all know, if it gets delayed, it must be good news.

Yup the ACA or Lord Fouls care is in force across the country kicking people off of healthcare plans they have been on for years and doing it’s best to bankrupt everyone! But hey, the libs at the No Brains Corp say it’s here to stay, so that’s that!

From what I understand, only customers enrolled though state exchanges qualify for subsidies. Customers enrolled though Federal exchanges do not.
What I see happening is Obama trying to force the remaining states to open exchanges and Congress to amend the law; Either that or “Justice Roberts has made his decision. Now let's see him enforce it.”
And of course, the ‘Pubbies will keep passing “continuing resolutions” to pay for it.

If the subsidies go away and everyone actually has to pay the full amount of the price of insurance ObamaCare is dead.

Actually, it's better than dead because all the deadbeats who now ride the system for free, clog up our emergency rooms and leave hospitals and taxpayers will have to pay a compulsory health care insurance or go to jail.

Kind of like mandatory liability insurance for automobile owners.

This could be the savior of our increasingly bankrupt medial system where we have too many users and too few payers.

If this happens, I'm all for it and I assure you the Democrats will be falling all over themselves to dismantle the system as their gibbsmedat low info voter base has to take a chunk out of their welfare payments and EBT cards to pay for their health care just like the rest of us.

The other little problem is that the majority of people can't afford to pay for Obamacare including the subsidized, so as mentioned it will go broke.

But the ones enrolled through the federal exchange are STILL getting subsidies, which is not what the law says.

Obama will never get any alteration to this through congress.
This is a FAR stronger case than the whole tax/penalty powers argument that we lost because of Roberts’ treachery. The big question was would the court hear it. Now they will.

I can tell you, Kagan, Bryer, Ginsberg, and the Wise Latina are going to have a devil of a time writing their dissent because there is just no conceivable way what is written could mean what the IRS is interpreting it as.

People on Obamacare can't afford the deductibles and co-pays. And they won't pay them. And that will be that. End of Obamacare for most folks.
