Judge defends custody decision in lesbian mom case

Family Court Judge William Potter responded Thursday to an allegation that he discriminated against a lesbian mother being deployed to Cuba.

“Obviously I don’t have a problem with her being gay because I gave her custody,” the judge said.

Potter’s comments stemmed from a Las Vegas Review-Journal story about the divorce case of Michelle Bagalawis, who since has changed her last name to Angeles, and Johnny Cardona.

Angeles and Cardona, who have a 7-year-old son, were divorced in January 2012. Angeles, a first lieutenant in the Air Force, married a woman in March 2012. After Angeles’ recent deployment to Cuba, Potter denied her request to keep the child in Las Vegas and ruled that the boy should spend the remaining three months of her deployment with Cardona in Texas.

In defending his decision, Potter also said the woman’s lawyer, David Mann, “might have an ax to grind.” The judge said he handled Mann’s personal divorce this year, and Mann did not show up for the trial.

The lawyer reacted to Potter’s comments by immediately filing a motion to remove him from the case because of an “appearance of bias.” He also took steps to file a complaint with the state’s Judicial Discipline Commission

The judge was right, there are two parents, the mother, who birthed the child and the father who provided the sperm. If the custodial parent is too damn busy for the child, the other parent gets the child. Period. Plain and simple. End of discussion. There is no reason ANY step parent of ANY stripe gets preference over a natural parent.

Why should their be a recusal? What about ruling on the lawyer’s divorce would make him bias in an unrelated divorce case?

Probably about 1/2 of the family lawyers will go through a divorce. In many cases, the lawyers on both side of a case will have gone through a divorce. Is the county supposed to bring in outside judges everytime a lawyer who was divorced in that district brings a divorce case to trial? I just don’t see any conflict of interest.

Interesting—When the libs disagree with a judge’s decision the judge feels compelled to explain himself.

youd think it was for three years or forever the way the hysteria over the decision went...

and the boy is 7, he needs his father...

Wait, I thought lesbians and homosexuals were born that way? How did she marry a man, have a baby, get divorced and then marry another girl, if she was born a man/lesbian?

How is it that the homosexuals I know and have come in contact with throughout the last 60 years all have children from a former straight marriage? How is it a civil right if you were once straight and then decided to be homosexual?
