Puerto Rico's Gay Marriage Ban UPHELD by Federal Judge

Puerto Rico’s ban on same-sex marriage remains in place after a federal judge dismissed a challenge to the ban Tuesday, saying the U.S. Supreme Court established a precedent four decades ago.

U.S. District Judge Juan M. Pérez-Giménez said in his decision that by dismissing an appeal in Baker vs. Nelson, a 1971 case in which two men sought to marry in Minnesota, the Supreme Court bound all lower courts to assume bans on same-sex marriage do not violate the Constitution. The high court could choose to overrule itself but has not, he said.

Pérez-Giménez went on to say that legalizing same-sex marriage would open the door to challenges that could legalize polygamous and incestuous marriages. “Ultimately,” he wrote, “the very survival of the political order depends upon the procreative potential embodied in traditional marriage.”

He dismissed the challenge with prejudice, meaning the case cannot be refiled.

EXACTLY. The Supreme Court has ALREADY de facto ruled on gay marriage in 1971, and essentially said that bans do NOT violate the Constitution. The Court recently chose not to overrule this previous ruling, which means that ACTUALLY, gay "marriage" bans are completely constitutional by the Court's own admission.

I think that case back in 1971 was dismissed, due to a lack of a federal legal question, or some such legal status at the time. So that case is the Supreme Court precedent.

The homosexual marriage cases ruled on last year did not address whether there is a constitutional right to homosexual marriage.

EXACTLY! A "sutainable" state requires future taxpayers... I would imagine that the Leftist argument would be to provide every Mexican, ISIS jihadist, and Obala patient defacto US citizenship... to make up for all the otherwise unproductive faggotry going on.

Is the race baiting necessary? Here is a judge who is ruling on this law as he should based on precedent. If a Hispanic judge is doing what Whitey has failed to do, good for him, but race doesn’t have anything to do with his. Only right does.
