Chris McDaniel has New Life to his Challenge of Thad Cochran’s Tainted Victory

Chris McDaniel has been fighting what he believes is a corrupt system following his unexpected loss in the GOP Senate run-off in Mississippi. His opponent, incumbent Thad Cochran, was accused, with evidence, of paying black voters to illegally vote in the run-off, as they had already voted in the Democrat primary and had no intention on voting Republican in the general election, and using another sleazy, lie-based tactic.

The Cochran campaign and its supporters stooped to disgusting race-baiting tactics to lure black Democrats to vote, accusing McDaniel of being associated with the KKK and telling them McDaniel would work to bring segregation back to Mississippi.

McDaniel has been fighting the irregularities and corrupt tactics in the election ever since the loss and has refused to concede. Neither the state nor the national GOP would back his investigation or consider its findings. But now, his fight has new and powerful political life breathed into it.

A Mississippi High Court has agreed to hear McDaniels case in the GOP primary dispute. As reported by the AP via the Houston Chronicle.

Attorneys for six-term Sen. Thad Cochran told the Mississippi Supreme Court on Thursday that a challenger waited too long to file a lawsuit seeking to overturn Cochran’s victory in the June 24 Republican primary runoff.

However, attorneys for the challenger, tea party-backed state Sen. Chris McDaniel, argued that current Mississippi law does not specify a deadline for filing a challenge of election results. McDaniel is asking justices to revive lawsuit that was dismissed in late August. The circuit judge who dismissed the suit agreed with Cochran’s attorneys that McDaniel waited too long to file.

Justices spent nearly two hours listening to arguments and asking questions of both sides. They gave no indication of when or how they might rule.

Whether McDaniel is successful or not, he is fighting them!

Hopefully, the people will reward him again with a public office.

I don’t see how the judges can do much on this. You’d have to do the whole primary again....way too late in the process to allow a primary before November date.

Isn't that illegal? I thought only Democrats were allowed to do that?

Or MS conservatives will send a message to Cochran, Barbour and the
GOP in November. Something like don’t tread on us or this is the price
you will pay.

From what I understand if Mary Landrieu doesn't get 50%, there will be a runoff in Louisiana of the top contenders regardless of party.

So if it can happen in Louisiana, it can happen in Mississippi.

Nine Supreme Court justices are elected from three districts. Non-partisan
elections are staggered so that not all positions are up for election at once.
Supreme Court justices serve eight-year terms.

Decisions are by a majority vote of the court.

In hearing the appeal does it mean if they find for McDaniel then the
lower court has to take up the appeal. Or does it mean the appeal is in the
hands of the Supreme Court?

Does anyone know?

They should have thought of that before. They already had one primary vote, and McDaniel won. The second vote was a runoff because the initial vote was too close. If they have to throw out the runoff then the initial primary vote is all they can go by, and McDaniel won. If Cochran didn’t want to blow his chance to defeat McDaniel in a runoff then he shouldn’t have disqualified the results of that runoff by committing election CRIMES.

I can’t see the courts allowing a flawed election to stand
if they find it to be flawed.

Thus either a new election or an appointed Senator to hold
the office until a schedule election could be held in two
years.. Who knows the potential outcomes at this stage.

I would suppose that the election must be held as scheduled, and there would be both Cochran and McDaniel on the slate.

Means the vote would go to the Democrat.

The judges in Mississippi are owned by Haley Barbour.

They are stalling for time, so that McDaniel cannot support a write-in candidate to oppose Cochran.

McDaniel has fallen for the trap and wasting his time in court.

No it is not too late, next door in Louisiana it is highly likely they will be having a runoff Senatorial election in December.

Hostage has the best info on this. It actually gets pretty crazy, I was tempted to download the whole MS election code so I could be analyzing this with truth.
