Onerous ATF rules threaten to put gun dealers out of business
Washington Times ^ | 09/18/2014 | Kelly Riddell

--snip-- The Form 4473 asks questions such as where the purchaser lives and whether the person has ever committed a crime.

Leaving one of the 132 items on the six-page questionnaire blank, or filling it in incorrectly, is an ATF violation. One violation can lead to a license revocation, which would put Mr. Stockman out of business.

Out of SSG Tactical’s 7,500 guns sold, the company could have made as many as 990,000 mistakes from the Form 4473 alone.

Turns out, Mr. Stockman’s team made about 180 errors — a 99.98 percent accuracy rate.

Another reason to never buy a firearm from a store or gun dealer. Filling out a 4473 literally puts a federal bullseye on your forehead.

Well, that IS what they were always intended to do!

Correct. Guns aren’t the moral equivalent to alcohol or tobacco.

If you have a CCL you don’t have to complete the 4473.

A CCL is just as bad as a 4473, same info, different method, same jackboots knocking at your door. The only reason to record ownership of firearms is to list those who the government will go after first.

Well, the answer is B. Because that was just workplace violence. </s>

Hey I’m for Constitutional carry and no background checks of any kind. But like I said if you have a CCl you can buy a gun anytime with no 4473 and no NCIC check. Obviously private sales are preferable but you can’t always get the gun you want in a private transaction either.

I stand corrected you do have to fill out the 4473 but you don’t have to get the NCIC check.

No. Not true for every state. In fact, only true in a handful of states.

OK, before this gets out of hand . . .

There a few states where a CCW permit acts as a substitute for a NICS check. I think maybe about a dozen states. I don’t know why these states qualify while most don’t but I believe it has something to do with the states routinely running CCW permit holders back through the NICS system on a regular basis. I live in Missouri and here your CCW permit does nothing to streamline a gun purchase. Buyers still have to undergo a NICS check.

Now, as to the premise of the article . . .

I’m an FFL. I had a BATFE compliance inspection a few months ago. It wasn’t bad. It took maybe five hours over the course of two days (an afternoon and morning). Of course, I don’t sell 7,500 guns a year like the folks in the story. I run about 500 4473 forms each year. I had three years of gun sales on my books by the time I was first inspected.

Again, it wasn’t a bad experience. Not nearly as bad as I expected. If a dealer does the tasks he signed up to do correctly he shouldn’t have too hard of time of it.

Screw the ATF. The ATF is a state-sponsored terrorist organization whose purpose is to attack women, children and babies, while avoiding all contact with groups of armed men.

I think you may not have to do a NICS check but I’m pretty sure you have to do a 4473.
