Ciminelli said Pierson's partner, Officer Michael DiPaola, returned fire and shot the suspect, who is in the hospital and in custody.

Officer DiPaola erred in not shooting the suspect enough. My sympathies to the officers family. Apparently it is only criminals that can possess guns in NY.
