Obama invents rights for illegals: Another "positive right" found nowhere in the Constitution

The left is very good at inventing rights that appear nowhere in the Constituion. These "positive rights" authorize the government to bestow goodies on the public, unlike "negative rights" which tell the government what it cannot do. Ergo, liberals invented the "right" to health insurance, the "right" to marry whoever you want to, and more. Poisitive rights are insidious in that they undermine the balance between liberty and responsibility. Moreover, positive rights chain the individual to the collective,. rather than free the individual from state control as negative rights do.

The Constitution does not grant rights. It simply restricts the federal government with an enumerated list of powers.

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people -- 9th Amendment to the US Constitution.

that , but I ma also trying to find where it is a constitutional right to marry for homosexuals, and where it is unconstitutional to not allow them to marry.

Drugs, illegals, borders social issue laws are all ignored

Its simply amazing that some of the parentless illegal alien toddlers were able to march north 5,000 to 10,000 miles on their own, find their way across the US border and locate the nearest ICE agent.

However, because of the bastardization of the “welfare clause”, the “good and plenty clause” and the “interstate commerce clause”, there is virtually no limit on what the federal government can force you to do.

The federal government must be put back in the Constitutional box. It won't be easy, and mainly, it will be up to the States.

All of these social issues belong to the States under their Police Powers.

While teaching in Chicago in the 90’s, Obama gave a series of interviews to a public radio station (they are archived online somewhere) where he openly admits if he could he would change our Constitution to be one extending these “positive rights” to housing, health care, etc.

Yep. I remember that. He obviously doesn't like the way our Constitution is set up to operate.

He wants a Constitution that limits the rights of people and gives government unlimited powers.

This is a very good article. The next level of discussion is that the original rights that are given to the people at God given rights, as the founding fathers defined it. As FedZilla tosses out God, it has to redefine the original rights which are God given, to positive rights which are defined by the god-state.

If the right exists, as with obamacare, only when the government provides it, then is it within my rights to demand a government provided spouse?

You see liberals, government “provided rights” always lead to slavery....but hey, that’s all fine and dandy for utoian fascists....

Yes, a COS is needed to redefine sections of the Constitution that have been muddied by decades of federal government meddling.

Jimmy was far from the worst President in history. There has been some real damage caused by some of the worst of the worst. Consider these Presidents, in no particular order:

-Woodrow Wilson: Brought us the Income tax. Brought the progressive era to a federal level. You can also thank him for Prohibition, giving the feds the tools for todays war on drugs. Finally, helped change the Senatorial elections to a popular vote.

-FDR: New deal policies, court stacking introduced, etc. Enough said.

Richard Nixon: EPA, price caps as policy, beginning of horrible domestic energy policy.

And of course, Obama is certainly on this list. I just wanted to point out that we have had some real damaging Presidents of the past. Sadly, we have never fully recovered from their damage.....

Positive rights are just a smokescreen for tyranny. What is amazing is how many supposedly educated and intelligent people fall for this garbage. It all boils down to what Ayn Rand said in many different ways which is basically this, if asked if I should have the right to take my gun and go to my neighbor’s house, rob him at gunpoint and take the money and give it to another who claims to be in need, pretty much any liberal on the Earth would say, “Oh, no, that would be totally wrong.” Yet the same liberals insist that the federal government, acting in the same way, is doing a great good.

Liberals are apparently incapable of actual abstract thinking. If a person simply imagines himself as the only human left on Earth he should realize that, in that situation, he would have no right to anything except what he can provide for himself. He would, in effect, own the entire Earth by default but that would not get him so much as a crumb of bread except by his own effort, anyone should be able to grasp that. What then makes people imagine that they have a “natural human right” to have things provided for them at the expense of others simply because those others exist? Oddly enough, many liberals who believe so strongly in having the government coerce people into supporting strangers will hardly lift a finger to help someone voluntarily. It would appear that Rand was right, those who vote for socialism always believe that THEY will be the ones receiving the benefits of having the government act as Robin Hood to rob from the rich and give to the poor.

A good liberal will naturally point out that RipSawyer is a hard hearted and cruel individual who has no feeling for others and does not believe in the “social contract” but there is a great divide between helping others voluntarily which is a wonderful thing and greatly to be encouraged and the forceful taking from Peter or Petra to support Paul and Paula which is simply armed robbery whether done by common thieves or government.
