Rape Victim Forced To Pay Child Support

A rape victim in Arizona is now being forced to pay child support. What makes this so wrong is that the one raped had been a 14 year old boy at the time.

Nick Olivas had been below the age of consent, which is 15, when a 20-year-old woman took advantage of his rough home life and emotional state. He was young and lonely, but being willing is irrelevant when you’re that young.

Olivas was never told that he had gotten the woman pregnant before they went their separate ways. He discovered the hard way that he had a six-year-old daughter after graduating high school and getting a job as a medical assistant. He never pressed charges because he didn’t know he was supposed to, and now, he’s literally paying for ignoring the forms he didn’t know were important.

Rape victim Nick Olivas has stated that he wants to be a part of his daughter’s life, but it wasn’t fair to him that he hadn’t known about her for all of those years. Now he owes over $15,000 for medical and other expenses incurred over the child, plus ten percent interest.

Olivas stated about his discovery:

“It was a shock. I was living my life and enjoying being young. To find out you have a 6-year-old? It’s unexplainable. It freaked me out.”

When Olivas discovered his debt and his daughter’s existence, he was served the papers as the bank seized his account. He now has nearly $400 taken out of his wages every month.

Usually when you hear about rape, it’s usually a man taking advantage of a woman, and justice is often lacking. As previously reported by The Inquisitr, a former judge determined that justice would be better served if women didn’t drink so much.

Nick Olivas has apparently been a victim since he was 14 years old, and it never dawned on him how much until now. It isn’t very often that the rape victim ends up paying for the crime. Thankfully, the money owed was determined to be due to the child, not the rapist.

Olivas wants to fight due to the circumstances of his ignorance of the situation, but with his employer following DES child support regulations, he can’t afford a lawyer. He is willing to support his daughter, but the way the process was handled irks the Arizona rape victim:

“I lost my mom at a young age. I know what it’s like to only have one parent. I can’t leave her out there. She deserves a dad.”

Nick Olivas is just a horrible example of how the law can work against the victim.

What's the statute of limitations on rape? If I were him I'd refuse to pay,let them jail me and then start suing everyone in sight,including the woman and the prosecutor.

Common sense, fairness, and respect for what is RIGHT and DECENT are apparently complete mysteries to the people on the courts responsible for defining and enforcing this "child support" travesty.

Those people need a serious ass-kicking.

Years Ago - Had an employee that the County or State kept garnishing his wages for Child support. This is a common practice in many states regardless of the man’s support payment history. Anyway they took money for a year & a half longer than he owed it. When he finally got them to stop they told him good luck in getting reimbursed by your Ex.

Not unique.
An acquaintance was in a similar position @15 years ago.
Was a young teenager when involved with an older woman.
Then got hit with paternity demands 10 years later.
Age is apparently no bar for liability here.

Refuse to pay and go to jail. Someone in the national news scene will have to pick up the story and take up the rape victim’s side.

This does show the lunacy of child support laws, its just a payoff to women for getting knocked up and has little or nothing to do with the childs well being.

I been pointing this out for decades.

Its nothing more than privatized welfare.

Recall in the 1990s when GOP supported extending these to federal enforcement as a part of welfare reform.

They couldnt wait to join feminists to punish the men.

Sad thing here is that a 6-year-old is, at best, being reared by an immoral slut of a mother.

Did the father ask for a paternity test?

One would hope that, since he says he wants to be a part of the child’s life, he would grow up quick, try to get at least joint custody, and rear the little girl to be better than her mama.

So he could file rape charges today. But what would that do to the child support payments?

The child’s age should easily prove the sex was statutory rape.

Sounds like he wants to support his daughter anyway, because it’s the right thing to do for her. Gotta respect his sense of responsibility.

The story is missing something or the math is off. He was raped @ 14 and found out he had a 6 yr old daughter after graduating HS and getting a job as med asst. Unless he graduated HS @ 20 years old!

From the link in this article, it seems that in AZ rape victims don’t have to pay child support to somebody convicted of rape. Maybe he’d still have to pay child support to the daughter. But he could report the rape, take a paternity test which would prove it was statutory rape, get the mom convicted, and get full custody of the daughter with no child support needed since he’s the custodial parent.
