US: Living dead man’s family must repay benefits

The government wants to recoup benefits paid to the daughters of a man who was declared legally dead and then turned up alive years later.

Donald Miller Jr. disappeared in the 1980s, and a death ruling in 1994 allowed his family to get Social Security benefits. […]

The SS benefits were his. He is the one who voluntarily ‘disappeared’. The daughters were innocent recipients. He is 62. Take it out of his Social Security.

in any case, if the courts will not allow him to come back to life, then technically he is dead—so why should they have to repay the money if he is still considered dead?

He's legally dead. Just shoot him. . . Problem solved. The worst the daughters could be charged with is vandalizing a corpse.

Better yet, they probably have a legal death certificate. Get a county permit to cremate the body and set him on fire. . . burn up the body. That way there're no misdemeanor charges. . . Unless someone complains about air pollution. Just have to check the legal burn days.

Damn. I sometimes have problems keeping my macabre sense of humor under control. This has been one of them.

The daughters have no legal obligation to repay. The government has to prove they knowingly defrauded it to collect. Good luck with it - and Social Security can go fly a kite.

When I make a mistake, I pay for it. Absent any evidence of fraud on the girls’ part, I don’t see how they owe any money to cover Social Security’s error.
