Mark Steyn has submitted an amicus curiae brief in the CEI/National Review -vs- Mann and it has some interesting language. Unfortunately, since it is a scan of printed document, rather than a PDF conversion, I can’t excerpt as easily, so I have to use screencaps.
Mann’s goal is to drag things out. Steyn lays out what it is all about – punishment by legal delay and the expenses it brings:

That’s a great brief, no doubt heavily edited by Steyn himself, full of his tell-tale wit and caustic humor. It will be interesting to see how the Court of Appeal takes it. My guess is they will laugh, but they will not be in a position to act any more swiftly on the appeal than on any other appeal. If the statute doesn’t have time provisions in it, there is nothing they can do. They can’t legislate time deadlines from the bench, and they can’t give his case priority over others that are in front of them. His point is valid, but it needs to be taken up with the legislature.
