Peter Sunde has asked to be moved to a different prison in Sweden, saying he has lost weight behind bars as the food on offer isn't suitable for his vegan diet.
The co-founder of the file-sharing site was arrested in May after almost two years on the run. Sunde is currently serving his eight-month sentence in Västervik, eastern Sweden, but wants to be moved to Malmö instead.
He has written to the prison authorities asking for the switch as he claims the meals served in Västervik don't meet his strict vegan requirements, reported the Sydsvenskan newspaper.
As a result he has shed several kilos and wants to be transferred to a correctional facility in Tygelsjö in Malmö.
His current base in Västervik is one of Sweden's most secure prisons whereas Tygelsjö has a lower classification.
The newspaper added that the prison authorities currently offer three types of food to suit differing dietary needs; regular diet, regular diet without pork and vegetarian.
At present, vegan is not on the menu for Sunde.
Sunde and his fellow Pirate Bay co-founders Fredrik Neij and Gottfrid Svartholm Warg, as well as financier Carl Lundström, were all convicted in 2009 of facilitating copyright infringement and ordered to pay 46 million kronor ($6.9 million) in damages to the music and movie industry.
Sunde later had his sentence shortened after a ruling at an appeals court.
He then went on the run and was believing to be living in Germany before he was seized at a farm in southern Sweden in May.
Meanwhile, the indictment against his fellow co-founder Gottfrid Svartholm Warg has been made public. The Swede has been in custody in Denmark since last November to face accusations he orchestrated a hacker attack on registries belonging to the Danish police.
Following a freedom of information request it has now been revealed that Warg, along with a Danish defendant, ia being officially charged with disrupting information systems, obtaining trade secrets and causing malicious damage.
The case will go to trial in September.
Pirate Bay was founded in 2003 and at its peak processed millions of downloads using peer-to-peer technology which enabled users to duck copyright fees.
It remains online despite several attempts to close it down.
