WINTER HAVEN (FOX 13) - A man breaking into a Winter Haven home Monday morning was shot and killed by the family living there, Police Chief Gary Hester said.
It happened at a little before 7 a.m. on Lake Marriana Road Drive. A mother, father, and son woke up to the sound of someone, identified by police as 40-year-old Mitchell Large, trying to get in through a porch door.
Chief Hester said one of the family members fired a warning shot.
"[A resident] fired a warning shot above the door. That warning shot did not deter the intruder. The intruder didn't retreat," Hester said.
The chief said Large made it into the kitchen. But by then,three members of the Pena family were armed.

They didn’t change the law — the existing SYG law was interpreted as allowing for warning shots.
So yes, they are within the law in both the warning and the not-so-warning.

Happy the family made it through, that sounds like a real predator was stopped before he could do irreparable harm to innocents. It’s heart-warming to hear a story where the victims were sufficiently armed to successfully defend themselves.
Constructive criticism though - discharging a firearm is by practical as well as general legal definition utilizing lethal force. If there is an imminent threat to life or limb that justifies the use of lethal force, it’s best to apply that lethal force to the threat and not to inanimate objects in your vicinity. Wasting time, wasting ammo, and sending lethal projectiles off into some random direction, are likely to make matters worse.
If there’s no threat that warrants lethal force, sending a lethal projectile zinging off into the nether is, to say the least, f***ing stupid. Demonstrating that you have no qualms about spraying your home or your neighborhood with lead is far less likely to end a potentially lethal confrontation than simply shooting the assailant.

The guy kept coming after a warning shot and was unarmed. I’m guessing a meth head.
