Judge Rules Justina Pelletier to Remain in State’s Custody

In response to the Boston Globe’s report that the state will retain “permanent” custody, Staver said, “there’s no way they could have done that.”

The Pelletiers say their daughter’s health is deteriorating. Two weeks ago at the one in-person visit they’re allowed per week with her, they said they noticed marks on her stomach that were worrying enough that they called them to the attention of Justina’s caretakers, who took her to the emergency room the next day.

Jennifer Pelletier, Justina’s sister, said in the most recent visit, Justina’s legs were more swollen and she lost feeling in her feet.

On Monday, the Pelletiers and their lawyers filed a contempt of court motion against DCF.

“DCF has abused its authority. DCF had no right to come between Justina and medical care,” Staver continued, noting that DCF said it would not bring Justina to Tufts until after Tuesday’s decision.

So what’s really going on with this girl? I can’t help thinking there’s something fairly basic about this situation that isn’t making it into these stories. Is there an allegation that the parents are causing some or all of the problem?

This case reminds me of the Terry Schindler Schiavo case, where a judge ordered that Terry be dehydrated and starved to death. He not only said that the feeding tube had to be removed but no one was allowed to feed her or give her water by mouth.

Terry was made into a test case giving the Government the right to kill us if the government decides we have a low quality of life. Is this young girl some kind of test case too? Is this case for setting some kind of precedent to allow the state to arbitrarily decide to take the children away if the state disagrees with how the parents are raising their children.

I have some familiarity of the inner workings of both Children’s Hospital and the Floating Hospital for Children (Tufts). Obviously, CH cannot respond to the various accusations against them without violating HIPAA.

I think it is very, very, very unlikely that CH has this one wrong. For them to take the position they have taken, all the facts must have been reviewed by the service chiefs, by the board, by house and outside counsel, by HMS and by CRICO. It is impossible to believe that there is not compelling evidence of Munchausen’s by proxy.

Of course the first-line clinical staff could have gotten this wrong. But the further up the line it went, the more likely it is that error would have been corrected. The stakes, if they are wrong, are enormous. Institutions like CH do not support errors by first-line staff. They just don’t. There is too much at stake.

Mass DCYF, of course, has no credibility, nor should they. But they are not the drivers of this scenario, they are just along for the ride.

I assume this is a State judge. State judges do endeavor to reduce the liability of the State, it’s their employer you know. So now with one sweeping decision all that has come to light recently...all that happened while the State had custody...boy that’s convenient -retroactively.

If you want to sue a State you need a civil rights claim that can be brought in a Federal court. When State officials see their home, car, boat and listed in a lawsuit then they run scared. And, for the next five years when they go to get that loan or insurance the standard question will appear: “Are you involved in any litigation?” To which they will have to respond: “Ah...well...there is this lawsuit for $3 mil, but don’t worry I work for the State and they’ll have to may for my incompetence”.

The psychologist assigned to the case has a research program somatoform disorder and written four papers on somatoform disorder. In one paper she postulates that as much as 50% pediatric illness is somatoform disorder, in other words they are faked symptoms/disorders.

If anyone has ever doubted that the USA is now officially a fascist country, then the kidnapping of this child from her natural parents for the sole reason of saving face by a plethora of fascist officials, then all doubts should now be answered by this action.

I had always heard how bad MA DCF was, but living in NY, I thought it couldn't be much worse. Seems I'm wrong.

Now, the parents willingly took her to doctors and then to the hospital. They were trying to help their daughter. Abusers usually don't do that. And then, after taken out of their care after a year she's 100% worse.

Now how could that possibly be their fault? And even if there is a mental issue, whatever, a child, teen needs to see her family. Nothing could make the situation worse.

I don't mean to downplay the holocaust, but in the picture up thread you see she has beautiful hair and is standing on ice skates. Now she practically has her head shaved and her muscles look like they're going to atrophy. She looks like a holocaust victim!

Also, why, if they really think the parents are so bad, don't they try to find her another relative/friends family to look after her? It's like she's being wear housed for no good reason! She should not be getting worse in the states “best” care!!! Have they tried to formally take custody from the parents and terminate all of their rights? Or are they doing this without custody even being established?

Anyone unfamiliar with the Massachusetts Department of Children and Families should know that it,along with every other part of this filthy state's government,is a train wreck.Kids under its protection disappear...they're murdered...they're molested.Absolutely nauseating.And after a particularly despicable case of a kid who recently just *disappeared* the head of the department (a typical Massachusetts Rat Party hack) offered her resignation our affirmative action Governor,Deval "Coupe Deval" Patrick (who's made it clear that he's running for President) publicly refused to accept the resignation.

Just another example of the fact that being a Massachusetts Rat means *never* having to say you're sorry.

I’ve dusted off a bunch of books I read awhile ago by Solzhenitzyn. The paralells are scary. I spent close to 40 of my 57 yrs living in the State of MA.....unfortunately, this does surprise me.

The regime knows what’s best for you, your kids and your property.
