Obama’s promise of executive action leads to disappointment

President Obama may have raised expectations too high when he vowed last week to take unilateral action to get around Congress — since his speech he has been flooded with requests and complaints from some of his staunchest supporters wondering why he left their issues out of his executive to-do list.

Immigrant rights advocates say he should have extended his existing non-deportation policy to cover all illegal immigrants, while marijuana advocates said he could follow through on his recent statements on pot by unilaterally taking the drug off the strictest tier of controlled substances.

Gay rights groups said Mr. Obama could have taken the same steps for them that he did on the minimum wage, issuing an executive order banning federal contractors from discriminating against gays in the workplace.

Cesar Vargas, co-director of the Dream Action Coalition, which advocates for young adult illegal immigrants, said Mr. Obama was picking and choosing, and said the groups involved have taken notice.

“It’s a lack of vision,” Mr. Vargas said. “He’s taking the easy ones — ‘OK, I’ll do unemployment benefits, OK, I’ll do some environmental [ones].’ But on major consequences of executive policy, he is backing down.”

In his State of the Union address, Mr. Obama laid out about a half-dozen areas where he said he wanted to see Congress act, but said if they didn’t, he could take interim steps on his own.

A key move was to raise the minimum wage for federal contractors to $10.10 an hour. He said he wants Congress to raise the national wage that high, but said in the meantime, he has the power to set rates for those companies that bid for federal work.

This was a ploy to see how much support he could get for subverting congress. Just to gauge interest and see how far he fan go. He’ll continue pushing.

I share your disappointment, while at the same time realizing there are a lot of people who have never been taught the difference between virtue and vice; who would receive and benefit from patient instruction along with us. Use whatever influence you have to assist the weak and confused, but never yield principle. And pray, because the Creator does answer prayer, knowing that all things will redound to perfection in the end, despite what we now see with our eyes.

From what I know about Executive Orders, and granted it may not be that much, there are usually two kinds:

1)Those that are truly ‘executive’ in nature, meaning he acts as the ‘CEO’ of the organization, in this case the Executive Branch, and directs them to such and such. They must still be legal and not unconstitutional. IOW, outside of one of his agencies changing a rule, guideline etc. it cannot compel me directly to do anything.

2)The order is broader in nature affecting more than just orders to the Executive Branch agencies. One might think this means anything. However, the broad order must have some legal basis and under some existing law. IOW, he just can’t make ‘new laws’. As for the minimum wage, he’d have to first come under Federal minimum wage laws, and then he’d have to legally justify why he can do this in the presence of a sitting Congress who are the ones to make the changes.

So I think he may try to raise the MW, but it will only be through agencies he directly controls; he cannot raise the minimum wage throughout the country legally.
