Another 'stand your ground' case? Florida shooting suspect claims he was attacked

ORLANDO — The gunman accused of chasing and killing a 21-year-old man at an Orlando apartment complex Thursday told police he was pursuing a suspected burglar and acted in self-defense after he was attacked.

This wasn't "stand your ground", this was an elitist ex-cop with an Erik Cartman "Authoritah" complex.

They really want everything to be a Stand Your Ground case because many of them would of course therefore be “controversial”. Of course the goal is to eliminate SYG.

As was argued by the prosecution in the Zimmerman trial, you lose your self defense exception if you are the agressor.

“Stand your ground” was not used in the Zimmerman trial.
It was simple self defense.

But the MSM for whatever reason wants to keep that narrative going.

Statistics show that African-Americans have used ‘stand your ground’ more than any other group - something like 3 to 4 times their racial makeup (30-40% of all cases).

The law is benefiting blacks the most because they live in the most dangerous areas: Around other blacks.

This doesn’t have anything to do with a former cop as far as I can tell.

In this case it sounds like the victim was shot multiple times in the back and the shooter was later caught by police and only then claimed self defense.

Another case of TALKING TOO MUCH.

1. I saw a burglar on my security system.
2. I went to check on him.
3. He attacked me, while reaching in his waistband.
4. I feared for my life and fired.

Exactly! Of course we know it means Zimmerman, for which that defense was never raised. But since it was once considered, and since in addition to raising the spectre of racism, the left wanted to use this case to go after guns, then of course a gleeful media was more than happy to feed the misperception by many that this was an SYG case.

This is going to be extremely hard to try in court, because the shooter made several very bad errors.

1) He pursued the perp after he had taken off. An extremely bad idea, both legally and tactically. Once they have left your personal area, you are not “defending”, you are “hunting”, in the eyes of the law.

2) Likewise, the number of bullets you can reasonably use once you have left your personal area drops drastically. In your area, you can empty your magazine, but on the hunt, if you use more than the minimum, the assumption is “intent to kill in the heat of anger.”

3) A terrible mistake was to flee then hide evidence after the fact, both the gun and the surveillance video recorder. That was a terrible mistake that will cost him plenty at trial.

4) Damning was that the perp had not actually done anything first. Peering through windows like a burglar is not a felony.

Adding it all up, I suspect the shooter will be convicted of some form of homicide.

There is legal precedence for it. During a robbery of a New Jersey jewelry shop, the owner struggled with a perp weighing nearly 300 lbs. During the wrestling match, the porcine perp got spun around, just as the shop owner brought his pistol to bear, and opened fire. Half dozen rounds entering the perp's back. Ruled self defense. Nothing in law says you first must take a beating, or wait for a second round of hand-to-hand fighting before you can defend yourself with lethal force.

The story reads kind of like a “Stand Your Ground” case to me.

A guy who wasn’t for certain at the time doing anything much wrong, except maybe looking in windows, was chased down by an aggressor, tried to stand his ground, and got shot.
