New York Man Shoots Rape Suspect and is Charged with Murder

A 43-year-old father of three has been charged with murder after shooting a rape suspect on his property in New York.

Many are hailing David Carlson has a hero for protecting his family and stopping a rape victim on the loose whom the police were chasing at the time, but because the state of NY does not have a Stand Your Ground law, Carlson has been charged with murder instead of being thanked by the police department.

The accused rapist, Norris Acosta-Sanchez, was on the run from police in Carlson’s community. He was found to be living in an abandoned cabin near Carlson’s home when police raided the cabin and failed to capture the rape suspect, who fled into the nearby woods.

All of the residents in the area were informed of the rapist on the loose and were on high alert. Carlson was aware of the situation as well, and when he saw the rapist on his property, emerging from the woods he did not take any chances. He fires several shots from his shotgun at the suspect and struck him multiple times.

Acosta-Sanchez was pronounced dead following the shooting.

According to another CBS article, at least one eye witness to the crime thinks Carlson is innocent,

Witness Carmine Ferrera spotted Acosta-Sanchez when Carlson already had his gun pointed at him. Because he’s scheduled to testify before a grand jury, Ferrera declined to provide specifics about what he saw, except to say: “I didn’t see a murder happen. That’s as far as I’m going to go.”

But police disagreed and arrested Carlson charging him with second degree murder after a lengthy interview with him.

Bail was originally set to $250,000 but the judge lowered it to $50,000. Carlson is not commenting on the case at this time, probably due to advice from his lawyer.

As mentioned in the video, because NY does not have a Stand Your Ground law residents have a “duty to retreat”, which is a duty that criminals love to see their victims follow. In this case, Carlson’s duty was to protect his family, and we will be watching this case closely, which will probably get no major media coverage at all.

Florida FReepers, and anyone else who's fortunate enough to live in a SYG state, take it from a former NY'er who lived just down the road from where this happened. Any threat to compromise the effectiveness of stand your ground laws must be thwarted

How is this a stand your ground issue? The suspected rapist was neither threatening the gun owner nor fleeing from the scene of a crime against the gun owner.

It is more of a “Stop you dirty b*****d or I’ll shoot” issue. Which is a different thing and a different level of culpability for the gun owner. Isn’t the first thing you are taught in a CC training class to never pull the weapon on someone who not either immediately threaten you or someone else?

The dead man may have been guilty of the things he was suspected of but he might not of been and he was not caught in the act.

Nope, this guy is not a hero though I understand his motives. He deserves to be charged with something.

It happened in Sparrowbush, between Pt. Jervis and Monticello in the SE part of the Catskills. And unfortunately he was indicted by a Grand Jury on Monday.

One of my former patients, caught a man in the act of raping her eleven year old daughter. She ordered him to stop, and he didn't. She shot him dead. The incident happened in Chicago.

She spent twelve years in prison for murder. She made the mistake of telling the Judge, she did not regret kiling the man, and would do it again.

It was a travesty, and a tragedy. Her daughter was grown by the time she got out of prison.

The biggest mistake my Patient made was that she left Texas to move to Chicago. Here, she probably would have gotten a ticker tape parade, instead of prison.

You cant go shootn’ any yahoo that strolls onto your property. Not in that state anyways.

This guy could have been the gardener next door or a rapist about to attack his daughter, but with out at least a perceived threat you cant just shoot someone you think might be the guy the cops are looking for....at least not in New Yawk.

Western Kansas be havin’ a parade for him.

So you're saying they did manage to bring an indictment on the ham sandwich. From this, it looks as if he'll wind up walking. The judge obviously saw something in the circumstances that made it clear the shooting was not reckless.

It sounds very similar to the African-American John White who waved a gun at a white kid and at some point the gun went off.

If the rapist went for the gun point there may be something similar.

Cuomo should pardon Carlson.

Cuomo should pardon Carlson
If he does run in 2016, or ends up being Her Thigness' running mate, he just might, to garner support from flyover country. He's an expert panderer, just like il Sfaccim, his father.
