McAuliffe to donate funds from convicted Rhode Island businessman to charity

McAuliffe to donate funds from convicted Rhode Island businessman to charity Terry McAuliffe's name popped up today on a list of investors who bought annuities from a Rhode Island businessman who pleaded guilty in 2012 to stealing the identities of terminally ill patients.

The convicted businessman, Joseph Caramadre, was also a donor to McAuliffe's failed 2009 bid for the Democratic nomination for governor of Virginia. Caramadre donated more than $26 thousand to McAuliffe and hosted a fundraiser for the candidate.

According to our NBC affiliate in Providence WJAR, there is no evidence that McAuliffe or the other investors, who include a noted bookie with mob ties and a Catholic priest in charge of financial planning for the Roman Catholic Diocese of Providence, had any knowledge that Caramadre was taking advantage of the patients on their death beds.

Caramadre stole the identities of the patients and then used them to apply for annuities and bonds. According to WJAR, he is accused of defrauding insurance companies between $37 million and $48 million.

McAuliffe's campaign was quick to distance the candidate from the report. They claim that while he had invested in the annuities he knew nothing about Caramdre's fraudulent activity.

"Terry was one of hundreds of passive investors several years ago and had no idea about the allegations against the defendant - who, at the time, was widely respected by business leaders and elected officials," said spokesman Josh Schwerin. "The allegations are horrible and he never would have invested if he knew he was being deceived."

Schwerin said that McAuliffe and his campaign would donate the equivalent of the campaign donations from Camardre to the American Cancer Society. $27 thousand from the campaign. $47 thousand from the candidate himself. The $27 thousand was to return campaign contributions. The $47 thousand was for the investment into Caramadre's business venture.

McAuliffe's opponent Ken Cuccinelli's campaign was quick to pounce on the news as another example of the candidate closely associated with questionable financial activity. Senior Adviser Chris LaCivita predicted that McAuliffe would claim to have no knowledge of what his associate was up to.

“There is no question that this is a deeply troubling story, and what it reveals most of all is yet another glaring example of Terry McAuliffe doing business with highly dubious individuals, said LaCivita. "We’ve seen this movie before."

The Cuccinelli campaign once again reiterated their call for McAuliffe to release his full taxe returns.

"It’s becoming clearer by the day why Terry McAuliffe has steadfastly refused to release his tax returns to the public. This is not the kind of behavior or judgment worthy of Virginia’s highest office,” said LaCivita.

Republicans also pointed out that McAuliffe waited until his name was publically revealed to give back the money.

"It's very interesting that Terry McAuliffe's decided to make his donation today, in October 2013...Caramadre, plead guilty to these charges nearly a year ago, in November 2012," said RPV Chairman Pat Mullins. "Terry only decided to give the money to charity only when Mr. Caramadre's client list was released to the public for the first time. It's not that Terry was upset that he was involved with something like this — he was upset that it became public."

Last year, according to Women Speak Out, more than 80 violations were discovered inside Virginia abortion facilities. But that doesn't seem to stop McAuliffe from defending them. This clearly shows his concern is for the well being of the abortion industry and not women.

Here's what he said: "I can do what I talked about, issue a guidance opinion by March to keep the remaining health centers open. I can do that myself as Governor. The SEC has subpoenaed bank records of GreenTech’s funding arm, the McLean-based financing company Gulf Coast Funds Management, LLC.

Documents attached to a July 31 letter from Sen. Charles E. Grassley also raise more questions on the extent of the interaction between officials at the two companies and Alejandro Mayorkas, the director of US Citizenship and Immigration Services (USCIS) in DHS.

DHS is investigating whether Mr. Mayorkas assisted in approving an investor visa application submitted by Gulf Coast, even after the application was denied and an appeal was rejected.

Mr. Mayorkas, Obama’s pick to be the next No. 2 at DHS, testified last week that the extent of his interaction with Mr. McAuliffe was one meeting in which he heard his complaints about investor visas being held up.

Mr. Grassley said it went further than that.“Contrary to the impression left by your answer, documents indicate that both before and after that meeting, you actually engaged in nearly a dozen contacts with Gulf Coast Funds Management between 2010 and 2013, including direct communications with Gulf Coast’s attorneys,” the Iowa Republican wrote to Mr. Mayorkas. “That one meeting with Mr. McAuliffe was clearly not the extent of your interaction on that matter.”

Officials at the two companies and did not immediately respond to requests for comment Friday. A spokesman for the McAuliffe campaign noted that Mr. McAuliffe left GreenTech in 2012 and that he has no knowledge of any investigation. News of the SEC investigation was first reported Friday by The Wash/Post.

The documents include forwarded e-mails from Mr. McAuliffe to Douglas Smith, an official in DHS’s office of the Private Sector, that were forwarded to Mr. Mayorkas and an e-mail from Mr. Mayorkas himself saying that face-to-face meetings for particular cases are not appropriate.”As the Director of this Agency, I do not adjudicate cases and am not the proper audience for a telephone call or a meeting about a particular case,” he wrote to Gulf Coast’s general counsel earlier this year. “I will forward your e-mail to the appropriate individual in the Agency.”

USCIS handles cases involved in the EB-5 program, where foreign investors put up between $500,000 and $1 million for American companies in exchange for legal status.

Govt attorneys wrote that such a meeting would violate the Administrative Procedures Act. “I think it also raises an impartiality issue if we entertain pre-decisional meetings of this sort with particular applicants and petitioners,” USCIS’s Ethics Officer wrote. “It is not a concern to have meetings with particular industries, trade groups, bar associations, etc., on systemic issues that are not case specific, so long as we are willing to meet with all.”

Gulf Coast is run by Anthony Rodham, the brother of former Secy of State Hillary Rodham Clinton, and is the finance arm of GreenTech Automotive Inc. Mr. McAuliffe founded GreenTech in 2009 and quietly stepped down as chairman in Dec — a fact only revealed in April in response to an inquiry from a Politico reporter.

disputes charges he misled investigators

RICHMOND, Va. — Documents in a federal fraud case list Virginia Democratic gubernatorial nominee Terry McAuliffe among scores of those who invested with a Rhode Island estate planner who profited from death benefits paid on policies issued on terminally ill people without their knowledge.

A 2011 fraud, conspiracy and identity theft indictment alleged Joseph Caramadre and an aide stole terminally ill people's identities and used them to falsely secure annuities or bonds that paid off when those people died.

Prosecutors produced the list Wednesday in a hearing for Caramadre and the associate, Raymour Radhakrishnan, who each pleaded guilty to wire fraud and conspiracy counts in November.

There is no allegation of wrongdoing by McAuliffe or that he or other investors knew of efforts to defraud the terminally ill. The Associated Press withdrew a story Wednesday night that said McAuliffe was accused in court documents of having lied to a federal investigator looking into the benefit scheme; those documents referred to someone by the initials "T.M.," but did not identify McAuliffe as that person.

Campaign spokesman Josh Schwerin said McAuliffe was a passive investor with no knowledge of the actions of Caramadre, "who, at the time, was widely respected by business leaders and elected officials. The allegations are horrible and he never would have invested if he knew he was being deceived."

The McAuliffe campaign donated $27,000 to the American Cancer Society and Terry McAuliffe personally gave $47,000 to the organization, Schwerin said.

McAuliffe's name appears on a long list of Caramadre's investors that prosecutors released during a restitution hearing in U.S. District Court in Providence, R.I., to support their claim that the scam cost insurance companies more than $46 million.

Prosecutors say Caramadre and Radhakrishnan took out variable annuities and so-called "death-put" bonds that would pay out when a person died. Authorities say they lied to terminally ill people to get personal information that was used to purchase bonds and annuities in their names without consent.

The list became public just 27 days before Election Day in the only competitive governor's race this fall. Recent polling shows McAuliffe has gained a slight lead over Republican Ken Cuccinelli in a contest that had been close.

Cuccinelli's campaign pounced on the list. Cuccinelli's chief political adviser, Christopher J. LaCivita, called it "yet another glaring example of Terry McAuliffe doing business with highly dubious individuals."

The identity of McAuliffe and other investors remained unknown until prosecutors presented Caramadre's list of clients and investors Wednesday.

The Providence Journal reported Wednesday that other Caramadre investors on the list included the law firm of a former Rhode Island Supreme Court justice, the former police chief of Cranston, R.I., and an officer in charge of planning and financial services for the Roman Catholic Diocese of Providence.
