European railway companies must give partial refunds to passengers who are significantly delayed by bad weather, natural disasters or strikes after a ruling by the European Court of Justice (ECJ). The judgment is a blow for train firms who up until now only had to pay out if they were at fault.
The Luxembourg court ruled on Thursday that the rules exempting train companies in cases of force majeure, i.e. where the problems are out of their control, relate only to the right of passengers to receive compensation for damage or loss resulting from the delay or cancellation of a train.
The judgment covers all railway companies in Europe and invalidates any conditions clauses they might have that exempt compensation in cases of force majeure.
The new reimbursement obligation does not apply to air, ship or long-distance coach transport.

This ruling currently exempts airlines, buses and sea travel.

Your Honor, the SafetyFirst Airline’s defense that their planes did not fly due to very severe weather is of no matter. Neither does their defensive claim that 5 planes of other airlines were brought down with over 3 hundred dead passengers have nothing to do with my client’s incovenience.

I wonder could the government be sued for earthquakes, floods, and inclement weather?
Extend that principle to public roadways and sidewalks. That could cover delays and possibly accidents. How about an outdoor public skating rink when its July but you are delayed until the rink freezes in November?
Where do they find mental giants that come up with this crap? In the good old days, we put them in strait jackets and mental institutions. Today we put them in black robes and court rooms.

How many trains will now operate in unsafe weather conditions because the operators don’t want to have to pay the passengers for delays?
Any time the euroweenies feel hurt or inconevienced, someone has to give them money.
Maybe we can get money from obama if it snows and it interferes with our plans.
