Americans who are fed up with Obamacare won a victory yesterday. The House voted to defund Obamacare while still funding the federal government to avoid a devastating shutdown. (I shall not digress, but its beyond distressing to hear liberals try to convince Americans that any government slowdown is comparable to terrorism.)
Now the battle goes to the Senate, and well find out if Harry Reid is so committed to the horrendous Un-affordable Care Act that hell be the one to shut down the government to fund the unworkable Obamacare.
Lets be clear. Republicans in Congress aren't advocating a government shutdown. Thats why they voted in the House to fully fund our bureaucracy while defunding Obamacare. The conservatives in Congress are listening to the majority of Americans who do not want Obamacare.

Those of us who hang in there supporting a major political party with our energy, time, and contributions would like to believe that that party would praise principled conservatives like Ted Cruz and Mike Lee for following through on campaign promises. Wed like to believe that the GOP establishment would applaud the way these bold leaders have rallied the grassroots to their cause. But, no, such praise would require a commensurate level of guts and leadership, and the permanent political class in D.C. is nothing if not gutless and rudderless.

The very next step should be to Totally Defund the EPA. You remember, those stupid leftist who have deemed new regulations that kill the coal industry.
CLOSE the EPA, Totally. Forever. Let the states determine how they will control reasonable environmental standards.
Then as Ted Cruz has suggested, Department by department pass a house bill for funding to prevent a shutdown of the government. Every thing except ObamaCare and the EPA and whatever other agency wants to overstep their authority in support of the O_Btard.

It amazes me to hear the talking heads and elected progressives tell us to suck it up because its going to be the law as if the people have no right to oppose, change, or eliminate it.
I was quite interested for a while in writing legislation to do just that.
The problem is (I did not know this when I started looking into it) that the EPA was not created by Congress, and no law authorizes it or describes its structure or authority.
The EPA was created by Executive Order (Nixon), to enforce laws Congress had already passed such as the Clean Air Act, the Water Quality Act, the Clean Waters Restoration Act, the Motor Vehicle Pollution Control Act, and others.
These are not really laws in the conventional sense, but rather enabling acts, directing or authorizing the President to do certain things such as "ensure clean air".
So, the authority to do the things the EPA does was (unconstitutionally) vested in the Executive Branch by Congress between 1955 and 1970, and the EPA is simply a device or contrivance by which the President exercises what Congress commanded. As such, it is totally within the President's area of responsibility.
So, there is no EPA law that could be repealed. If Congress (somehow) ordered the President to revoke the EO creating the EPA, it would be necessary for the President to create other structures to carry out the underlying acts of legislation.
In this regard, the EPA is a lot like Obamacare - sort of para-constitutional. Once established without proper authority, impossible to remove.
Repeal the law that Congress passed which enabled the President to establish the enforcement agency.
