Can 0.00bama fund it through an EO, as an ‘emergency’ measure, bearing in mind that 0.00 has made so many changes to legislation through EOs, rather than Congress? (This is NOT a suggestion, merely a query by a Canuck who does not know the ins and outs of the US government, particularly funding.)

If they passed the bill in the senate as-is, and Obama signed it, he could easily just keep spending the money. By the time anybody could even start the process of using the courts to stop him, December 15th would roll around, and the entire thing would be moot. No court would rule that anybody had to give any money back.

No.

EO is only internal within the executive branch. Granted, this 'Resident has pushed the envelope a bit, making executive orders that have effects outside the executive. However, spending money... so far... is not in this category. Indeed, since the lower house, the one that has elections every 2 years, closest to the people, has SOLE revenue origination power, they should do the same with AF1, white hut, and on and on.... just defund the executive. We could easily do without it for 3 years. Then, ramp back up when it has a real occupant.

He can try anything he wants. Would he prevail? On this, probably not. Congress is pretty jealous of the purse strings.
