There is a special rule in Virginia for assault weapons, you have to prove State registry and proof of citizenship to get one. I think that is what stopped an AR-15 being used.

(Ted Cruz understands the law, and he does not fear the unlawful.)

"Proof of age (18+ for long arms, 21+ for pistols) and proof of citizenship (or permanent residence license) are required for the purchase of "assault weapons". "Assault weapons" are defined as a semi-automatic, centerfire, firearm equipped with a folding/adjustable stock, or equipped at the time with a magazine capable of holding 20+ rounds, or capable of accommodating a silencer/suppressor."It sounds like he could have purchased a fixed-stock AR version as long as he had the shop keep the standard magazine. Then he could have walked back into the store, and bought 30 or 20 round magazines. As AWB states go (versus here in the People's Republic), Virginia's restrictions aren't too bad.
