State Law Prevented Sale of Assault Rifle to Suspect Last Week, Officials Say

WASHINGTON — The gunman who killed 12 people at the Washington Navy Yard on Monday test-fired an AR-15 assault rifle at a Virginia gun store last week but was stopped from buying one because state law there prohibits the sale of such weapons to out-of-state buyers, according to two senior law enforcement officials.

Instead, the gunman, Aaron Alexis of Texas, bought a law-enforcement-style shotgun — an 870 Remington pump — and used it on Monday as he rampaged through the navy yard, said the officials, who requested anonymity b

When the FBI is called for a NICS check no distinction is made between the two.
They only ask long gun or pistol.

So he got what he could and traded up on site. When we were kids, anyone with a little wood working skill and a car antenna could have a .22 pistol in a couple of hours. That sort of butterknife gun is the sort of wish for more wishes that inspired the Liberator pistol.

When someone is hell-bent on creating mayhem, only an alert and prepared populace is sufficient to stop them. No law, no ban, will ever trump the workaround.

right - and yes, some 870s are tactical configuration for police. This article makes it sound like ALL 870s are tactical weapons.

The Remington 870 is one of the most, if not the most, popular shotgun for duck and bird hunting. From the brief look I had at a picture of the weapon, it looked more bird hunting than tactical - but I can’t say that for certain.

There is a special rule in Virginia for assault weapons, you have to prove State registry and proof of citizenship to get one. I think that is what stopped an AR-15 being used.

I have a Remington 870 shotgun and slugs for it - should I assume I am a criminal? Is that becoming the criteria? As in someone uses a certain weapon to shoot people so that means if you have a weapon like that, you also are a killer waiting to happen?
