The picture was taken by an employee of The Record, owned by North Jersey Media Group. It is private intellectual property and cannot be used without permission, most particularly by someone with whom the owners disagree politically.It is entirely possible Sarah didnt realize this was private property. When pointed out to her, she apparently took it down, which was the right thing to do.
That picture has been shared millions of times on Facebook without a peep from those who own it. But Sarah Palin does the same thing, and they slap her with a federal lawsuit.
Does that not give you even a little twinge of outrage?

I think that after all the lawsuits shes been put through, someone shouldve been a little more careful about checking on the licensing. Maybe Sarah should check with her lawyers before she blows her nose....

The image depicted here was not used for editorial use or personal use. It was used commercially. She posted it on her personal Facebook page to accompany a written tribute to the victims and heroes of 9/11. How is that commercial usage?

If Palin can show that it has been used many times without permission by the copyright owner, then the copyright owner can not enforce his rights to the image. It becomes 'public domain.'
When claiming a copyright, the onus is on the owner of that right to enforce his right. That is why you see Disney go after pre-schools that use images of Mickey Mouse without permission even if they are making no money on the image. If Disney allowed them to use it without permission, Disney could lose their rights to Mickey Mouse.

There is nothing sinister about the copyright owner complaining about unauthorized use of their photo for commercial purposes. Oh, they didn't just complain. They slapped Sarah with a federal lawsuit, despite the fact that she was merely using the picture as part of a tribute to the victims and heroes of 9/11 on a Facebook page (like millions of others have done).

According to posters upthread, Getty has a web crawler that scans cyberspace to find unauthorized usage of their images. When they do, a letter is sent to the user.
They appear to be protecting their copyrights.

Copyright lasts for the life of the author plus 70 years. It is NOT public domain.
I agree that their going after her is totally chicken sh!t, but they are in fact completely within their rights to do so. And we all know that of Hillary uses that on her facebook or campaign web site page, they won’t say a damn word.
