All same-sex couples who are legally married will be recognized as such for federal tax purposes, even if the state where they live does not recognize their union, the Treasury Department and the Internal Revenue Service said Thursday.
It is the broadest federal rule change to come out of the landmark Supreme Court decision in June that struck down the 1996 Defense of Marriage Act, and a sign of how quickly the government is moving to treat gay couples in the same way that it does straight couples.
The June decision found that same-sex couples were entitled to federal benefits, but left open the question of how Washington would actually administer them. The Treasury Department answered some of those questions on Thursday. As of the 2013 tax year, same-sex spouses who are legally married will not be able to file federal tax returns as if either were single. Instead, they must file together as married filing jointly or individually as married filing separately.
Their address or the location of their wedding does not matter, as long as the marriage is legal: a same-sex couple who marry in Albany, N.Y., and move to Alabama are treated the same as a same-sex couple who marry and live in Massachusetts.
Todays ruling provides certainty and clear, coherent tax-filing guidance for all legally married same-sex couples nationwide, Treasury Secretary Jacob J. Lew said. This ruling also assures legally married same-sex couples that they can move freely throughout the country knowing that their federal filing status will not change.(continued)

Pay up and enjoy that marriage penalty!
After all, 2 can live cheaper than one, so please no complaints about paying that extra tax!
Any government that takes the depraved position that equates two homos with a husband-and-wife is one that isn’t worth either respecting or preserving.
can't wait to the "married" military realize this when they get "divorced"....
and child custody, God forbide, but that will be a nightmare.....
pay up boys....pay up...
It’s all about the money.
Married people pay more.
I predict that as the percentage of homosexuals getting married increases, the number of normal people getting married will decrease. Straight people will see homosexual marriage as a desecration of their beliefs.
If the homosexuals and the state can redefine marriage to mean something that it isn’t, then I would like my church to create a new word for what used to be called marriage and perform those ceremonies. They won’t be recognized by the government, but they would be recognized by God and by fellow Christians.
You want words to mean whatever you say they should mean? Two can play at that game.
Government by feral government bureaucratic decree: how much more streamlined can it get? Now, if only we can talk the Department of Education into spiffing up that pesky old Constitution written in eighteenth century English for us!
Get them IRS!!
Welcome to “equality”
“They wont be recognized by the government, but they would be recognized by God and by fellow Christians.”
and they wont be taxed at the higher married rate.
Holy Matrimony <— is that what this would be called?
Marriage is a legally binding covenant with the state.
I don’t know the answer but I like your idea of calling the bond between Man and Woman something other than what they call the whatever it is between a man and a man.(I think I just threw up a little in my mouth)
This IRS rule should require the gays to file either joint or separate returns. No more single filing. If their intent is to treat gays the same as straights they must do this, because straights are required (with only one or two exceptions) to file either joint or married filing separately (which is the highest tax rate). But I bet they won't.You'd be wrong. From the quoted section of the article:
As of the 2013 tax year, same-sex spouses who are legally married will not be able to file federal tax returns as if either were single. Instead, they must file together as married filing jointly or individually as married filing separately.I don't like losing another battle, but this at least seems to be equal treatment.
Same with all that shack up, I am tired of people shacking up, playing house and not suffering the penalty that married couples do.
I’ll bet the IRS won’t enforce this. There’s millions of dollars in back taxes that could be collected by auditing the single returns of married gays—but the IRS won’t touch that with a ten-foot pole. Now targeting the Tea Party, that’s something else altogether.
They could not legally file married on past tax returns. The IRS cannot retroactively force a penalty which did not exist at the time.
