Vanity: Is it about time for Congress to use their 'Special Prosecutor' powers?

I can't for the life of me, folks, figure out WHY Boehner and Congress have not to date used their legal and Constitutional powers of appointing special prosecutors to try corrupt government officials in the Obama Administration over "phony scandals" Benghazi, the IRS Tea Party targeting, NSA and others?

This seems especially poignant since Boehner said that it mattered set (IRS) agents would end up in jail over tea party targeting!?

Now they act like nothing has happened/Have they gone limp?

Maybe it's time to remind Boehner and all that they have this power?

special prosecutor generally is a lawyer from outside the government appointed by an attorney general or, in the United States, by Congress to investigate a government official for misconduct while in office. A reasoning for such an appointment is that the governmental branch or agency may have political connections to those it might be asked to investigate. Inherently, this creates a conflict of interest and a solution is to have someone from outside the department lead the investigation. The term "special prosecutor" may have a variety of meanings from one country to the next, from one government branch

A bizarre form of a Mexican Standoff, but basically that’s what happens. The result is political paralysis.

Before long, there will be Mexicans running congress so the term Mexican Standoff will be an accurate description of deadlock in the future. lol

Because they’d rather use the leverage they have to cut deals.

You see, your initial premise going into this is wrong. You believe there are Congressmen who want to identify corruption and clean it up. False premise.

Congressmen are there to extend their power and use their positions to benefit themselves. There are infinite examples supporting this premise, so that is not a cynical view, but the absolute truth.

Because it’s not a constitutional power. It is a very unconstitutional power. In fact, one of the best dissents in the history of the Supreme Court is Scalia’s excellent analysis of why an Independent Counsel appointed by congress and/or the courts violates the separation of powers:

“Without a secure structure of separated powers, our Bill of Rights would be worthless, as are the bills of rights of many nations of the world that have adopted, or even improved upon, the mere words of ours.”

“Frequently an issue of this sort will come before the Court clad, so to speak, in sheep’s clothing: the potential of the asserted principle to effect important change in the equilibrium of power is not immediately evident, and must be discerned by a careful and perceptive analysis. But this wolf comes as a wolf.”

The dissent is a great education on the Constitution and is also notable because it accurately predicts all of the problems caused by Lawrence Walsh and Kenneth Starr.

The law which created the Independent Counsel appointed by Congress (which the Supreme Court erroneously upheld, over Scalia’s objection) expired in 1999 and Congress did not renew it.

As I recall, Congress can request a special prosecutor, but it is still up to the AG to appoint one - they can’t force him to do so, and they have no power to appoint on on their own (separation of powers). The Independent Counsel law used to allow Congress to appoint a prosecutor, but it was deemed unconstitutional and abandoned.
