Black Man Shoots White Teen, Jury says Self Defense. And Nobody Cares
TTAG ^ | 18 July, 2013 | Tim McNabb

Posted on 07/19/2013 6:04:24 AM PDT by marktwain

Huh. Roderick Scott went out of his house to confront a trio of punks breaking into cars in his Greece, New York neighborhood. Scott’s story was that he fired two rounds at one of them when the young man charged him after being told to freeze and wait for the cops. So, we largely have an inverse image of the incident in which Trayvon Martin perished, complete with the kinfolk weeping thusly . . .

“The message is that we can all go out and get guns and feel anybody that we feel is threatening us and lie about the fact,” said Jim Cervini, Christopher’s father. “My son never threatened anybody. He was a gentle child, his nature was gentle, he was a good person and he was never, ever arrested for anything, and has never been in trouble. He was 16 years and four months old, and he was slaughtered.”

Alas, for the future value of the Christopher Cervini trademark and subsequent merchandise sales, young Chris didn’t really look like the son of anyone famous or influential. If they’d had one.

How heavily did stories of gangs of rednecks beating the life out of a black man hang upon the mind of Mr. Scott in the split second before he pulled the trigger? Who cares?

The jury clearly believed that Scott was in fear for his life when he defended himself, and all the second-guessing and carping about him being a wannabe cop went either unmentioned, or unheeded. Absent more information that the state, with all its resources, was not able to cobble together a case to the satisfaction of the jury, I believe that Cervini’s death is one of the possible outcomes of a young man being out screwing around when he shouldn’t have been.

When I was growing up, that’s what I was told. Run with a bad crowd, bad things can happen. Act a certain way, dress a certain way, mouth off to the wrong person, and bad things can and do happen.

Neither President Obama nor Attorney General Eric Holder were not available for comment.

This guy had the expectation of being physically harmed - where Zimmerman was already harmed physically and where he actually believed that Martin was going to kill him if he lost consciousness...although a group against a father who’s in fear of his family needs to be taken into account, as well as, he fired two shots - how many times did the 16 yr get struck - once or twice?

Americans are getting fed up with the collapse of society and the rise of anarchy.

Governments are unable — or unwilling — to do anything about it.

It is probably unwise to confront young hoodlums, but once the decision is made to do so, being armed is a person’s only promise of personal safety.

Oh I believe in being armed, just not the willy nilly use of deadly force. Regardless of the shooters/targets race.

This case isn’t being mau-maued by black (brown, etc.) race-baiters because the defendant is black and was acquitted.
This is what journo-retart Leo Pitts calls (drumroll please): “racial justice.”

Reminds me of this old line:

Q: Why did you have to shoot the mugger six times when it took only one bullet to do the job?

A: Because I was in fear of my life and the gun only had six rounds.

Anyone with a sense of justice is digusted with the obvious doublbe standard that depends whether or not you are a member of the 'protected' class.

This thug-boy got what he deserved, too, but at least HE had the gonads for a face-to-face confrontation instead of hiding in the bushes like a coward.

Some more facts about the New York case:

It occurred in 2009.

The teenager had a high level of alcohol in his blood.

“Three against one is not a god scenario for the “one”.”
////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////

Some years back there was a news report of a fifty year old man who was killed in this area by some teenage girls, the motive was thought to be robbery. I believe there were three girls and the one thought to have stabbed the man to death was fifteen. I don’t know any more about it.

“From another story on this case “The prosecution claims Cervini was actually shot from behind. “

A comment from TTAG says the bullet entered under the armpit and exited out the back. This is entirely consistent with shooting from the front, and the attacker turning as they evaluate the threat.

There is action/reaction to consider. Defensive shootings tend to be dynamic situations. It is perfectly plausible for people to be shot in the back legitimately in defensive situation, because they are moving when shot at.

“The teenager had a high level of alcohol in his blood.”
////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////////

Alcohol can sometimes turn a very mild mannered person to violence. It can also cause some to make threats they cannot carry out. Forty plus years ago I was in a real redneck honkytonk place (yeah, I was young and stupid) when I noticed an auto mechanic I barely knew staggeing around trying to start a fight. He was not what you call big but he was around six feet and 160 and all muscle, not a weakling at all when sober. I tried to calm him down but he was really drunk so I caught his hands and placed both of them together and held both his wrists with one of my hands and led him around until he became so exhausted he finally sat down and behaved himself. The next time I saw him he did not even remember the incident. When I told him what I had done he said, “Damn, I MUST have been drunk for sure.”

Seems like he was pretty quick to fire.

According to the article linked to:to confront a trio of punks
At the trial in 2009 the shooter "Scott says he shot Cervini twice when the victim charged toward him yelling he was going to get Scott"

Yeah, nailed him with two quick shots - in the back according to what the white kid's aunt said in a comment in an article in the American Thinker: (March 24, 2012)

kcervini1%40gmail.com
Hi, My Name is Kristine Cervini and I am the Aunt of Christopher Cervini. Our family, has plenty to say about what happened to Christopher. If, you think what happened to us is Justice..think again! Christopher was not only unarmed he was shot in the back. Ask, yourself..How did Roderick Scott get away with cold blooded Murder? Do, you think the Laws were followed here in New York State? We too, are fighting for Justice. We want an investigation in our case, because everything Roderick Scott did was against the Law. Roderick Scott, was given a badge of honor while our child died at the hands of this insane crazy lunatic. Almost, everything to do with our case has been classified as official and can no longer be viewed. We would love to speak with Michael Filozof, that wrote this article.

That's something I'd read, but since it doesn't matter to me if they're high, drunk, or just stupid...attacking someone because they're trying to stop you from committing an unLAWful act deserves what they get.

So I really didn't think it pertinent to mention.

Exactly. Relatives (and prosecutors) make all kinds of claims to make dead perps look 'innocent'.

Martin's parents still claim 'he was an unarmed teenager minding his own business and walking home with his candy'.

This didn’t happen in NYC, which has its own, very stringent, gun laws. The incident occurred in Greece, NY, which is a town in upstate NY, near Rochester. I know a guy with CCW in upstate NY. Outside NYC, it’s up to the local law guys whether to be stingy or generous in giving out CCW licenses.

“It is perfectly plausible for people to be shot in the back legitimately in defensive situation...”

Makes sense. An attacker, running towards their victim and then noticing a gun pointed at them, might dodge one way or the other at the last second in an effort to avoid a shot...even twisting around. Sort of like throwing up your hands to “block” a round that is being fired at you.

Exactly right. It can easily take a half a second from the time the decision is made to shoot, to the the time the bullet leaves the barrel. A lot of motion can occur in half a second.

Several years ago we had a guy try to climb in my sons window. He changed his drunken mind when he saw the barrel of a .45 pointed at his head.

I did go outside and watch him stagger to his car and drive away. I didn’t chase him down but I did call 911, who didnt seem to care since I hadnt killed him.

I was wondering if the 2nd bullet hit somewhere else...I never saw if the one hit was hit once or twice...there have been incidents where police have to be accountable for the rounds they shot — per the bi-annual range qualification...a legal requirement — just wondering...and yes, I would agree - given the circumstances - a large hostile crowd outside his house would give reason for self-defense and defense of one’s family...he didn’t create the situation - they did...

Relatives (and prosecutors) make all kinds of claims to make dead perps look 'innocent'.

I clearly was being too vague in my remark "a jury has spoken" attempting to show that I had some doubt about the case. The usual wording is "the jury has spoken", a difference which was pointed out when BO said "a jury has spoken" and there were suggestions that he had in mind that there would be another trial and another jury .

I had quoted the aunt'scomment that Christopher Cervini had been shot in the back by by the perp. The closest I could come to confirming that was this from an internet search:

Judge Sets Roderick Scott's Bail at $25,000 "It could be construed that a shot in the back would be less indicative of a self defense claim however that will ultimately be up to a jury to decide," said Finocchio. ... Again Roderick Scott claims Chris Cervini said "I'm going to get you" when he was running towards him. rochesterhomepage.net/fulltext?nxd_id=83731&nxd_25741_start=22315

No kidding. That article is no longer available but there is no reason to believe it was a fake article. The jury took 19 hours to reach a verdict. I'll still go with "a jury has spoken".
