We can't accept the practice that says, "what is Constitutional is what we say is constitutional."
I haven't read the opinions, and even if I did, I may not be able to follow the liberal justifications for them (if the majority even bothered to reference what part of the Constitution compels the decision made.)

Their ‘justification’ boils down to this “The peopel are not qualified to bring propositions to a vote- ONLY state employees are qualified to ie gov, DA etc- basically what htey are satying is that it doesn’t matter if the state violates the constitution when they ram through a law like NY with hteir unconstitutional gun laws, or Cali’s gay marriage rule- the peopel have no right to brign a proposition to a vote because hte people’s will isn’t a valdi concideration for law apparently
The supreme court basically dropped it back down to the district court’s decision to override the people’s proposition vote because the ‘peopel didn’t have the right representatives their to defend prop 8’ meaning that the peopel didn’t have any state employeees to represent them/ represent/defe3nd prop 8 IE: Sicne hte peopel brought soemthign that they initiated, it was an invalid appeal to the supreme court because only state employees can bring such cases to the SC-

I don’t think I can overstate how concerning it is that Scalia’s is often a lonely voice when it should be in the majority, if even needing to be raised from accepted, unspoken understanding. What is to become of the America I was taught about when young?
