There will be a court battle over this. I hope the committee didn’t lose it’s right to press her by excusing her. I know he said it was subject to recall, we will see.

I know she asserted her innocence in her statement, and that could be viewed as a waiver of her right on the whole topic area.

However, when you are testifying, it’s possible to assert the right as soon as you realize the questioning might incriminate you. So even if a judge orders her to testify, it’s possible she still can assert the right again at some point.

You can be sure this all will be litigated. Lots of delays.

I think she waived her fifth amendment right when she made a statement that she had done nothing wrong. May turn out her attorney gave her bad advice. We'll see. Hope that she is made to come back.

Except that being in contempt of Congress has very little meaning if the DOJ won’t prosecute.

Well, if recent history is any indication, she’ll still refuse to answer (and maybe even show up), be deemed in contempt of Congress, and that will be the end of it.

She doesn’t have much to fear when the enforcer of any penalty against her is Eric Holder.

According to insiders in her testimony Ms Lerner quoted O.J. Simpson: “I yam 200% Innocent!”

How can this be handled to the Republicans’ best advantage?

First, the Republican Committeemembers’ staffs should prepare hundreds of IRS-scandal-related leading questions to be presented to Lois Lerner. For example, ‘’When was the first time you spoke about this to the President?’’

Next, Ms. Lerner should be invited back (subpoenaed) for open-ended Congressional hearings, at which the prepared questions will be asked day after day, and Ms. Lerner can either embarrass herself by remaining silent, implying guilt, or repeat her statements of innocence, boring everyone and implying she’s a fool.

After a week or two of this, the name ‘’Lois Lerner’’ will have become as well-known and ludicrous as the name ‘’Monica Lewinsky’’ still is — a certain laugh line for every late-night comedian.

And the public will identify Ms. Lerner closely with the President since the Republicans’ questions will imply that she visited Obama in the Oval Office to discuss the IRS issues as often as Monica Lewinsky once visited Bill Clinton to discuss their areas of interest.

Why can’t they just start at the bottom and work their way up? Drag in the low level employees and start hammering them.

IMHO only, she, or her attorney, skewed this whole thing in the first place.

The 5th protects someone from "self" incrimination...or testifying against one's self.

She stated she was taking the 5th to keep from incriminating others...and to make that worse, she is aware then by that admission she knows others to be guilty of incriminating acts criminal acts).

From the live thread today....

To: St_Thomas_Aquinas

Again from Hot Air:

After she reads her statement where she asserts her innocence and pleads the 5th…

Issa says…OK…We understand that, say would you mind just authenticating whether this IG transcript is we received last night is…authentic…We’d really appreciate that..if you don’t mind.

All lawyer chummy…very polite.

Well I haven’t seen that she replies.

Issa says…Oh so sorry…here hand this to her so she can authenticate it please.

She bit.

It looked to me like a cross examination and response.

Looked like a nifty trap to me…and Gowdy saw that too.

Maybe…Gowdy spoke out but was really talking to her lawyer…Cause she screwed up her 5th pleading both in the opening statement and responding to Issa’s innocuous request for authentication of evidence related to the investigation.

If I were her lawyer…I’d try and convince her to cut a deal and spill the beans.

It’ll be fun to watch her don the wardrobe of Annie Lee Moss of the McCarthy era, or was it Annie Lee Moses?
