I think the problem here is that no one in the 1770s worried about nuts. So we have an open situation where nuts can vote, nuts can buy or sell weapons, and nuts can openly kill people and just get off on any major crimes because of their mental issues. There probably should have been some rule in the beginning that if a judge declared you incompetent....you lost out on most of your rights.

The trouble is now....you can’t revisit this without everyone wanting a 40-page list of funny rules added.

crazy people are not new. there use to be wards / homes / prisons for such people

they were shut down in the 70s.

Judges determining peoples competance/status/humanness is not a good idea. Think Dredd Scott for a moment.
