Benjamin M. Wassell, an Iraq War hero who, despite a traumatic brain injury from an improvised explosive device that destroyed his vehicle back in 2006, was able to lead other wounded Marines through a minefield to safety, was the first person charged in violation of the New York State Safe Act.

Iraq War hero Benjamin Wassell faces seven years in prison for the violation.
Wassell pleaded not guilty today. Guns.com reported:
A Western New York man now faces seven years in prison for violating Gov. Andrew Cuomos new gun control-law, the NY Secure Ammunition and Firearms Enforcement Act (or SAFE Act).
Benjamin M. Wassell, an Iraq War veteran, was charged with twice selling newly banned military-style assault weapons and standard-capacity magazines to an undercover police officer as part of a sting operation conducted by State Police and the New York Attorney Generals Office, the Buffalo News reported.
Altogether, the 32-year-old Silver Creek resident was slapped with three felony charges and one misdemeanor, which as noted could end up putting Wassell, who has no prior convictions, behind bars for as many as seven years.......

We need to keep asking those who wish to disarm us:
Why do your police need the weapons of war ?
Why do they need M-4’s with holographic sights and 30 rnd magazines ?
Who are you at war with?
They dress like military, are armed like military, and have all the accoutrements of military
Here’s something to think about; A young person could survive a 10 year sentence, however for a person in their sixties or seventies, 10 years would most likely be a life sentence.
If you give someone a life sentence, are they less likely to be taken alive. I wonder if the Jack Boots have considered that?

I just hope that Ben’s defense attorney makes DAMN SURE the jury knows their God-given rights under the Jury Nullification Doctrine.
The judge will NEVER instruct the jury that they have three options for reaching their decision, not two. They can find the defendant guilty, find him not guilty on the facts as presented, or find him not guilty because the damned law itself is unjust. The judge wants a quick and easy decision; he doesn’t want the court’s time wasted in a nullification decision. Too damned bad.
I would LOVE to sit on the jury for this case. Hoo yeah!

Some years ago I was forman of a jury that exercised its right of Nullification. We were not instructed by anyone, but we knew that it was the right thing to do. The Prosecuting Attorney was livid.
I am 64 and with my health issues, I can guarantee you that even 7 years would be a death penalty for me.
