Utah Governor Gary Herbert criticized efforts to oppose federal firearms restrictions and declared that Utah will obey federal gun control laws.

As courageous state legislators enlist in the fight to repel the federal government's assault on the Second Amendment, the governor of one western state is telling a liberty-minded state representative to stand down.

Governor Gary Herbert of Utah recently called a pro-gun rights bill sponsored by a Utah state representative "an exaggeration" and encouraged the lawmaker to "adhere to the law."

This is not the level of support citizens of the Beehive State would expect from the man they elected to lead their state.

Herbert was specifically criticizing a measure offered by first-term Representative Brian Greene (R-Pleasant Grove). The bill is titled the State Supremacy Firearms Act.

Too bad he was just re-elected. Huntsman picked him as a running mate—so perhaps this is not unexpected. Pity.

So in Utah you have the governor and the sheriff of Salt Lake County on the feds side, and the remaining 28 sheriffs, on the side of the Second Amendment. Ergo, Salt Lake City is just like most other big cities, except that they don’t have the leaders of the Mormon Church hiding under their desks on this issue.

That’s fine, as long as they are actually laws, passed by the people’s representatives, assembled. Not the unlawful whims or dictates of a power-grabbing executive.

Add to that list the Marxist Police Chief of Salt Lake City who said recently that he didn’t think it was unconstitutional to ban assault weapons, high capacity magazines and otherwise put limits on guns and ammunition.

We should expect as much from the brain-dead democrats in this country. But I am more than mildly curious how these constitutional scholars completely pass over “...shall not be infringed...” and think that means “We can do anything we want”

No, it isn’t fine. What if the people decide to pass laws that order blacks to sit at the back of the bus, or to be hanged whenever found in certain areas of the town? The Constitution is supposed to place some things beyond the reach of local sentiments, or even elections.

Oh, and one more thing about Herbert. What can you expect from a RINO that wants to spend millions more on education, and talks about the value of it, but he, himself, is a college dropout. Why doesn’t he put HIS money where his mouth is and go back and finish his degree?

If money were the measure of education success the Washington DC schools would be the best in the world!

And if anybody thought the Mormons doing temple work campaigning for Romney were a minority ~ or that Harry Reid was an anomaly, they have this socialist brigade inside and near the core of Mormonism.

They'll never have a successful presidential candidate until they give it up. That goes or the non-mormons in Utah who go along with the mormons to get along.

As Justice Marshall observed in deciding Marbury v. Madison, when two laws are in conflict, the superior one controls; and as between a statute and the constitution, the constitution controls. When the feds pass unconstitutional laws, nobody is bound to follow them, The laws are ultra vires, "beyond the powers" of the entity that issued them.

So, I gather the governor supports unconstitutional laws, provided those laws are passed by the feds and endorsed by the federal court system.

That's also the current state of federal law, as stated by the DC Circuit. The Supreme Court declined to hear the case. "Heller II."

Didn’t the Supreme Court recently rule last year that states are not allowed to enforce federal law? Or does that only apply to immigration and not the “good” laws?
