LAYTON A burglary suspect who was fired upon by a homeowner has been taken into custody by police in Layton.
The suspect was identified as Robert Santos Cruz, 47, of the Salt Lake City area, said Lt. Shawn Horton.
The incident happened around 4 p.m. at a home at 2536 E. Gentile, near Valley View Golf Course.
Neighbors identified the homeowner as Clare Niederhauser.
Around 4 p.m., the homeowner came home and saw a green four-door vehicle parked in front of the house. The driver was a woman, and there was an older male passenger.
The driver began honking the horn, and the homeowner saw a man come out of the house with what appeared to be a pry bar. The homeowner went back to his vehicle, got a handgun and fired twice. It was not clear if he actually shot at the man with the pry bar.
