Sen. Dick Durbin (D-Ill.), the No. 2 Senate Democrat, said the administration was forced to use recess appointments because of Republican intransigence.

“In its frustration, this administration said ‘we were elected to govern,’” Durbin said. “And whether it’s the National Labor Relations Board or whatever they wanted to put people in place to govern.”

The Senate must be in recess for the President to make a recess appointment. They were not. The court has ruled the appointments invalid. Any actions they have taken since fraudulently being appointed are null and void.

Like Politico, Dickie boy didn't read the court decision either. I did.

The court said, "In any event, if some administrative inefficiency results from our construction of the original meaning of the Constitution, that does not empower us to change what the Constitution commands."

Maybe, DumBO should appoint people to boards that are not anti-American who require intransigence from Republicans.

It evidently does not occur to Sen. Durbin that Obama, seeing that his first choices for the NLRB could not win Senate confirmation, might instead have selected some more fair-minded and less radically pro-union appointees who would have sailed through the confirmation process, or simply left the posts unfilled and the NLRB non-functional, neither of which decisions would have proved unconstitutional.

I give this a month and Obama’s people will still be there, their regulations will remain in effect, and if it goes to the Supreme Court Roberts will do what Obama tells him to do.
