The State of Kansas, which does not recognize same-sex unions, is pursuing child support from the man who donated sperm to a lesbian couple because the childs mother is seeking financial aid. Kansas Gov. Sam Brownback's administration is seeking to pass the cost of that child support on to the sperm donor of the lesbian couple involved. According to the Huffington Posts Dec. 30 report, William Marotta, a Topeka mechanic, may have to pay child support for a child he signed away all his parental rights to.
The story begins when Marotta answered a Craigslist ad for a sperm donor. Angela Bauer and Jennifer Schreiner, a lesbian couple, placed the ad in March 2009. As part of the agreement between the parties, Marotta gave up his rights and his financial obligations toward any forthcoming child.
The Kansas Department of Children and Families sees it differently though and has filed a claim against Marotta. When Schreiner and Bauer sought financial aid due to an illness that Bauer unable to support her family, welfare officials demanded the name of the father before aid could be given.
Together Schreiner and Bauer have eight children. Though the couple is no longer together, they still co-parent are very close. Because the state does not recognize same-sex unions, Bauer cannot be made to pay the child support. With Bauer unable to work, Schreiner turned to financial aid to support her family.
Even though the couple has a signed agreement with Marotta, the state is arguing the validity of the agreement because a doctor did not handle the artificial insemination as required by state law. Hannah Schroller, Marottas attorney is attempting to have the case dismissed. Arguments will be heard in state court next month.

RE: What could go wrong ?!?
You are seeing it unfolding right now!!
This, in itself, is sheer madness.
Win this one and watch out for a person who keeps another alive by donating a kidney, heart, liver etc and the recipient goes on a shooting spree.
Watch for ‘them’ to come back and sue the heirs or donor because without the ‘new heart’ the person would have died etc.
No. You don’t understand. In Kansas and I’m guessing in most states. there is a special statute for sperm donations but they have to be done anonymously through a doctor or clinic. That filter protects the sperm donor from future claims by the mother or the child. What is not understood is that the child him/herself has a claim on the father for up to three years after he/she reaches majority. This is the child’s claim and can only be blocked by statute.
I don’t care. All of this makes it clear that only a fool would donate sperm under these circumstances. If you do, you open yourself up to enormous financial liability.
I think sperm donation is immoral and stupid anyway so no argument from me.
Did they list him on the birth certificate?
RE: Did they list him on the birth certificate?
It’s been over a decade since I last saw a birth certificate... with the redefinition of the family already in place, is the line for “father” still required to be filled? or can one just leave it blank or type in N/A, or Unknown?
