Dick’s Sporting Goods is refusing to fill orders for guns that were paid for

In a move that potentially may spark a class action lawsuit, Dick’s Sporting Goods is refusing to fill orders for guns that were paid for weeks ago.

Russell Kellner of Flower Mound, Texas said he and his wife bought three Troy Defense Carbine Semi-Automatic Rifles on Black Friday at a cost of $799 each, a $300 dollar discount.

“It was a heck of a deal,” said Kellner. They received two of them, but were then notified by Dick’s on Christmas Eve, that no more orders would be fulfilled...

This is a knee-jerk reaction and does nothing but fuel the dialogue on gun control. If I were a gun manufacturer/distributor, I would reconsider putting guns in Dick's stores. They're either going to sell them, or they're not. Shouldn't pick and choose which ones and when at their leisure.

We have a few Dick’s shops, but they will not again be bothered by my presence.

In any case, we now have a Bass Pro shop going up...and why bother with wimpy little dorky (Omama-like) stores when there is a real one around?

Hmmmm, I wonder?

Knee jerk reaction or profit?

Those guns will probably bring $12-$1400 right now. Why sell them for $799 if you can find some reason not to?

For the record, I’ve only been in Dick’s Sporting Goods twice, didn’t like the place, and have never been back.

Who needs Dick’s? We have a Sportsman’s Warehouse, Academy Sports, and a few gun shops in the region. That ought to cover most of my sporting needs.

I recall from my job in a gun store many years ago that Federal law gives the dealer broad discretion in refusing to sell to anyone if the transaction just doesn’t “feel right”.

That is likely enough wiggle-room to get them out of the lawsuits.

The GF drug me into a Dick’s before Christmas. Ammo was wiped out. Lines to registers were 1/2 way around the store.

Soccer moms and pop culture were wiping out the clothing and sport gear.

Dick’s had a very good Christmas.

Dick’s Sportin Goods are penny wise and pound foolish.

Most likely they are seeing this as a cost cutting measure. This is when the suit replaces the brain.

They are still selling baseball bats (very deadly) and gold clubs.

Yes, they will probably get out of any lawsuits by purchasers but from the article it sounds like they have exposure on the distributorship contract.

So the article is apparently misleading. Refunds are being issued — just not for the real value of the guns.

I’m no lawyer, but from a legal standpoint, it looks like Dicks did what it was required to under the law. Actually, by issuing the gift cards, it went beyond what is legal and customary for a refund policy. Most stores will give a refund or credit if something goes wrong in a transaction, but there are situations where a merchant can refuse a refund or a credit (trying to return a clearance item, for example). Perfectly legal.

I don’t like Dick’s knee-jerk reaction, but I don’t see how a court could require Dicks to compensate purchasers further. I don’t think there are damages for pain and suffering when an item is no longer offered for sale.
