Rep. Trey Gowdy (R-S.C.) on Friday vowed to subpoena outgoing CIA Director Gen. David Petraeus if he won’t testify voluntarily about the Sept. 11 attacks in Benghazi, Libya.
Gowdy said that while he regretted the “personal ramifications” of Petraeus’ sudden resignation over an extramarital affair, it would not stop Congress from hearing from him about the assault on the consulate that left four Americans dead.
“The fact that he’s resigned and had an affair has nothing to do with whether or not he’s gonna be subpoenaed to Congress,” Gowdy said on Fox News’ “On the Record with Greta Van Susteren.” “I hope we don’t have to subpoena a four-star general and the former CIA director, I hope he would come voluntarily, but if he won’t he will be subpoenaed and none of what has happened today is a defense to a subpoena.”
The CIA has come under sharp scrutiny in the wake of the Benghazi attacks. Petraeus had been slated to testify Thursday at closed congressional hearings before the House and Senate intelligence committees, but acting CIA Director Michael Morell is now expected to take his place.
“There’s no way we can get to the bot of Benghazi without David Petraeus,” Gowdy said. “While he might not be around next week because he’s got personal matters, the week after that and the week after that, this excuse will run stale.”

Doesn’t matter if they subpoena him or not. If the CIA doesn’t clear Petraeus’s testimony, it’ll be a whole lot of “I can’t comment on that question/statement.”

Just as the administration claimed it was purely coincidence that our Benghazi consulate was attacked on the anniversary of September 11th. Now it’s purely coincidence that this affair — extra-marital affair — surfaces right after the election, not before, but right after, but before the intelligence chiefs go to Capitol Hill to get grilled. My gut tells me this ends up with the CIA basically telling any Congressional investigative committee to go f*** itself and the proceed to stonewalling. End of story.
There is an alternative....closed-door, off-the-record hearings, with the testimony classified as “National Security” and all those involved forbidden to publicly disclose the results under penalty of law. That’s actually a distinct possibility.
They could have him testify in private and then redact his testimony.

I don’t think immunity is the issue. The CIA would cite “national security” as an excuse for not allowing him to reveal classified information. That excuse would not work in a closed session, but then we the general public would not learn what happened.
I think it is clear that the regime waited until after the election and then started the purge. They now have a choice position with which they can reward one of their loyalists. The larger question now is: What will Petraeus say in his testimony? I think they need to have a closed session and ensure he can discuss classified, otherwise he may not be able to say much. That may be what the 0bama regime is counting on.
Congressional Committee...secret session...grant of immunity = he testifies fully or he's held in contempt of Congress.
I liked Mr. Gowdy’s visit on Greta the other night. So far he was the only one who’s explicitly stated that Petraeus will testify, voluntarily or not. Many other Republicans who have spoken on the matter use phrases like “He really needs to,” or “We would like him to,” leading me to think they’re eventually going to fold as usual.
Here’s what really bothers me, though, and I’m hoping somebody can reassure me. I don’t think I can think of a flimsier excuse for Petraeus to resign (as Peter King said on Fox this morning, looking back through our history as a nation were Eisenhower, FDR or MacArthur forced to resign for extramarital affairs?), yet that’s exactly what this administration expects us to believe.
As thoroughly corrupt and unfailingly evil as Hillary and He Who Shall Not Be Named and their ilk are, they’re not stupid. It makes me think they know some technicality we don’t that will preclude Petraeus from testifying, and it’s precisely how these disgusting lawyer types weasel out of consequences every time.

What a lot of people are overlooking here is that this all really comes down to Petraeus, not the CIA or the Obama White House. They can come up with any reason they’d like to keep him from testifying, but if he willingly goes and testifies — most likely under immunity — he can sing like a canary and there isn’t much they can do about it.
He will testify. He needs to find safety and protection for his family FIRST, they are in danger. He needs to seek this protection from Congress.
Once his family is secured, and if he lives long enough. He will Testify. JMO

If you’ve had access to CLASSIFIED material, when you leave the position that gave you access, you are debriefed. The standard verbage generally says something to the effect “ you are not allowed to discuss anything unless specifically permitted to do so”. That is why the committee needs to evaluate the situation and how they approach his testimony. If they don’t do that, then they will likely end up with no answers from him.

as of now...its only in the “oversight” committee.As more of this comes out...as more people “flip”..then a “select committee” to investigate will be formed..then the fun will really start..supoenas will fly. One thing I have penned down. The first person to mention the film, was Petraeus, when he first testified. From that point on, the president and Hillary and UN Rice were stuck on the film.
Trying to predict from here what will happen is useless. The congressmen in House and Senate will hold their hearings and they know what to do with Petraeus as they know the law regarding testifying and will follow that to get Petraeus testimony.
I have to believe that Petraeus is an honorable man who will tell the truth no matter what that means to him or the president or Hillary or Rice or anyone else involved.
Until his testimony is released to the public, I have no opinion what happened in Benghazi to cause the death of our men as I think his testimony is the beginning of the truth that will unlock the rest.
