BISBEE Two U.S. Border Patrol agents communicated by radio with agent Nicholas Ivie prior to the Oct. 2 shooting that resulted in his death in a remote area of southern Cochise County, based on information released by the Sheriffs Office on Friday.
Several reports totaling 39 pages were released to the media after a public records request. Some information in the documents has been redacted, including the names of the surviving agents and most ballistics evidence.
Ivie, 30, was fatally shot on Oct. 2 at around 1:30 a.m., when he and two other Border Patrol agents responded to a sensor alert near mile marker 352 on Highway 80 about seven miles east of Bisbee and about five miles north of the U.S.-Mexico border.
A female agent was not shot, while another male agent received serious but non-life threatening injuries to his buttocks and leg. The injured agent was airlifted from the scene of the shooting to a Tucson hospital for surgery, and he was later released.
During an interview with authorities on Oct. 2, the female agent said she arrived in the area with a male agent. They arrived in their own vehicles, parked and proceeded on foot from the south. Ivie was also responding to the sensor but was coming from the north.
The two agents were in radio contact with Ivie. At one point, the female agent observed Ivie signaling them with his flashlight, but she did not specify how close he was to them, or how long it was prior to the shooting that he did so.
"Agent [name redacted] stated as they were walking up the trail she heard yelling and then observed muzzle flashes in front of her and heard gun fire which she described as rapid but not automatic gun fire. She drew her weapon and took cover. Agent [redacted] did not recall if she fired her weapon. She did say she conducted a magazine exchange," states a report.
"Agent [redacted] stated the muzzle flash was from a long gun. She also described seeing the reflection of a handgun. She thought she observed three to four people moving in the area but she could not describe them. She also mentioned hearing whispering. She could not say if it was in English or Spanish. Likewise she did not know if the previous yelling was in English or Spanish. Agent [redacted] did not know what time the shooting occurred," it continues.
"Agent [redacted] stated she never saw [Ivie]. She did not see him before the shooting or afterward. The only way she knew he was in the area was through their radio communication," the report continues.
After the shooting, the female agent reportedly tried to remain calm and hidden. When she observed a Blackhawk helicopter, she contacted it by radio and gave her location. The helicopter picked her up, as well as the male agent who was injured in the leg and buttocks.
It is not clear where or how many times Ivie was shot. Portions of a report detailing the condition of Ivies body have been redacted except for a sentence stating "blood appeared to have come out of his ears, nose and mouth."
A visual examination of Ivies duty belt showed both spare pistol magazines were still in their pouches. The only belt items not in their holders were his flashlight and duty pistol. His radio was still on and operating. Some spent shell casings were located near his body, but the amount has been redacted in the report.
In another location, at least six spent rifle casings were found near a black nylon under belt that is used with a patrol duty belt. This belt belonged to another agent. There was also a blood trail, with splatter patterns indicating the source was moving south down the hill.
The investigation is still considered as open and on-going, according to Carol Capas, spokeswoman for the Sheriffs Office. She said additional supplements to the report are expected to be completed within the next two weeks when the entire investigation packet will be submitted to the Sheriffs Office for review.

They tried so hard to make this a “friendly fire” incident. Agents I know are not buying it, I think more will come out about this- though it seems the plan now is to just sweep it under the rug.
They sent a girl to do a man’s job
As I recall, an additional half dozen citizens were killed in order to provide cover to political correctness before the actual perps were finally caught on a tip from an alert citizen.
Most of his PHYSICAL APPREHENSION was by a citizen. And the younger guy almost escaped from jail months after his arrest..!
The Agents I know and spoke with (too include my son, an AZ Boarder Patrol Agent), this incident smells of friendly fire. No way around it. Friendly fire is the last thing “they”(Agents and the Patrol) want.
Having been in combat, I fully understand temporal distortion and selective (focused) attention that might lead to gaps in information, but in this case. . .too much is missing from Agent Redacted’s testimony.
Consider, she is reported to say she observed “Ivie signaling them with his flashlight, but she did not specify how close he was to them, or how long it was prior to the shooting that he did so.” Then, she said “she NEVER saw [Ivie]. She did not see him BEFORE the shooting or AFTERWARD.” What?
And signaling with a flashlight is not done at night, in the brush, approaching unknown people that might be armed (known drug smuggling corridor), and you are not sure where they are at (some could be right next to you, in front of you, behind you. You don’t know.) Signalling with a flashlight gives away your position. . .its like yelling in a silent room.
She said she can remember drawing her weapon and taking fire. . .but she can’t recall if she fired her weapon?
Can’t recall firing her weapon so much that she needed to do a “magazine exchange”?
If she wasn’t doing aimed fire, then what was she doing. . .reflexively firing blindly into the dark shooting at noise and shadow?
Border Patrol Agents are taught to identify and aim their fire. . .not just blast away.
It is reported she said she thought she observed three to four people moving in the area. . okay. . .reasonable. . .but she can’t recall if the whispering or YELLING voices were in English or Spanish?
Hiding until a helicopter arrives. . .what about her partner, the injured Agent? She didn’t make an effort to locate him, listen for him? If true, no Agent will EVER want to go into the field with her. . .ever.
And what about the injured Agent? His comments/testimony are missing in the news report. His comments are what will be very telling.
Trying to make the incident friendly fire to insult Agents and the Patrol? Not at all likely. Big Sis Nappy-Pants trying to make it drug-related to protect a female agent? More likely than this being a friendly fire incident.
I am sure more info will be released at a later date.

Meant to add: And if she says she never saw Ivie, then how does she know the flashlight signal was from him?
That plus the fact that the female border agent can't remember whether she fired her weapon or not but did change mags? This is incredibly mind boggling. Is everything connected with the fedgov a tangled web of deceit and coverup, everything???
And let’s not overlook the fact that the surviving injured agent and what he has to say is not mentioned in the news report.
Was his testimony withheld?
Was his testimony damning of the female agent?
Most assuredly so, in both cases.
Given Big Sis Nappy-Pants and her slavish devotion to promoting females, and given the fact if this turns out to be an incident where a female agent panicked and started to fire blindly would hurt Nappy-Pants and her agenda, it is easy to see that (dirty) Nappy-Pants is just like her boss, The Messiah. . .promoting a political agenda over the lives and well-being of American citizens.
Sounds about right. Feminazism is evil. Pure evil. Many conservatives do not realize how evil feminism is. Women are NOT the same as men and are not interchangeable with them and there are many jobs and professions that they are not suited for nor capable of doing. It’s just simple Mother Nature.
Until society recognizes that fact we’re screwed.
There is one job that they are especially suited for and men can’t do, but so many have been brainwashed into rejecting that job.
