And Chris Matthews, Mika Brzezinski, Rachel Maddow, Bill Mahar, Ed Schultz, Whoopie Goldberg, Eliot Spitzer, James Carville, Lawrence O'Donnell, and a host of other brainiacs would be delighted to explain to you exactly why it was a felony.

I’m sure it is a felony, but since he’s a Demonrat, he won’t pay $5 or spend 5 minutes in jail for it. If he were a Repub every network would be howling for blood.

It's a grey area. He mostly just talked about it and there's not enough there to charge conspiracy. He could argue that he was just humoring O'Keefe's investigator and was going to turn him in to the authorities and forgot about it.

The O'Keefe videos are great at exposing the attitudes of the Left, but in almost all cases they are the ones suggesting the crime. If this were a law enforcement sting it would be tossed out as entrapment.

(Don't flame me, I think the video is great for what it reveals about the rats, I just don't think there's a crime there as adjudicated by U.S. courts in this day.)
